Why are all US-bound BMW i3 EVs with range extenders stuck at port?

The first BMW i3 EVs have been delivered in the US, but in a quirk of the rules, none of them have been the range-extended versions. Long-time BMW electric vehicle driver Tom Moloughney discovered this fact the hard way. His i3 REx has been sitting at a New Jersey port for over a week and he's getting impatient. The problem is something Moloughney calls a "Monroney Hold." So, instead of sitting there fuming, Moloughney did a bit of research and discovered that the problem is something he calls a "Monroney Hold." He says that "the EPA certification has not been completed so BMW doesn't have a Monroney label (window sticker) to post in the window before the car leaves the port, which is required by law. The range extender option changes (shortens) the car's electric range, and also requires an official MPG rating so BMW couldn't use the same Monroney label as they did for the all electric i3." You can read more on his website, but it turns out that the story isn't so simple. For one thing, the EPA testing has been finished. Washington State representative Chad Magendaz told Moloughney that he asked the EPA for an official statement and got the following from Linc Wehrly, Director of the Light-Duty Vehicle Center Compliance Division: "EPA tested the i3 REx and provided the results of that testing to BMW on May 13th. EPA is not aware of anything that would prevent BMW from importing the vehicles since May 13th." Then there's the official word from BMW. Spokesman Dave Buchko told AutoblogGreen that: We are moving as quickly as possible to release the first BMW i3 Range-Extender models to BMW i Centers. Receipt of test data from the EPA is one step, but not the final step, in the process of receiving certification from the EPA. Rules do not permit the release of vehicles for sale until EPA labels are finalized, produced and affixed to any vehicle. Barring any unforeseen delays, we expect that to happen by the end of this week. We have never certified a vehicle like this before. We are taking every precaution to make sure that everything is done in a timely, but more importantly correct manner. In that Monroney labels cannot be produced until the EPA certification process is complete, the characterization [of a "Monroney Hold"] is not technically incorrect, but there is more to it than that, as is often true in life. It could be in Japan, where the plug-in car is being sold to potential customers online. The online retailer, long the largest in the US, is posting listings of the i3 on its Japanese site, notes Yahoo News, and both the standard electric i3 and the one with the gas-powered range extender are available. There are almost 50 dealers in Japan that can sell the i3, the German automaker's first production plug-in vehicle, but BMW appears to be trying to extend its distribution reach a little further. Of course, it's not a simple point-and-click situation, as prospective customers who order the vehicle online will apparently get a follow-up phone call from a BMW representative asking for proof of both access to a charging station as well as a parking spot. "It's become a tradition that the BMW Group breaks new ground with BMW i and that also goes for the way the vehicles are sold, with several different sales channels being tested and used," a representative with BMW's Germany headquarters wrote in an e-mail sent to AutoblogGreen. "In Japan, a one-off test project, designed only for that market – has seen BMW i3 models offered via Amazon. The delivery and customer service of these vehicles is, of course, handled by authorized BMW i dealers in Japan." BMW started selling the i3 in the US last year, moving about 6,100 units in 2014 and almost 2,700 through the first quarter of this year. BMW looking to fix i3 acceleration problem uncovered by Consumer Reports

The BMW i3 has been hailed in some quarters as the future of electric mobility, what with its innovative carbon-fiber-reinforced plastic body and commitment to sustainable materials wherever possible. The modernist little hatch is even available with a 650cc two-cylinder gas engine with 34 horsepower to act as a range-extender for those who want it. However, that optional engine might have a drawback - at least for the moment.
Consumer Reports brought the problem to light when one of its drivers was behind the wheel of an i3 using the range-extender. When the driver attempted to pass another vehicle on a rolling, two-lane road, the BMW suddenly had no power to accelerate - a scary situation. CR started examining the car and found something pretty shocking: After driving at a constant speed for a while without any regenerative braking in range-extended mode, acceleration to 60 miles per hour plummeted from about 9 seconds normally to a staggering 27 to 40 seconds in their testing.
A BMW spokesperson told CR that it knows about the problem and has a fix coming next spring that also works on current models. The upgrade includes a state of charge indicator, a warning about loss of power and uses the car's navigation to boost the battery before driving on rolling terrain. It is not clear if the severe power deficiency will also eventually result in a recall.
