BMW slapped with discrimination suit by EEOC

According to a report from CNNMoney, BMW has been hit with a lawsuit from the US Equal Employment Opportunity Commission after revised criminal background check policies resulted in the dismissal of 88 contractors, 70 of whom (that's about 80 percent) were black. A total of 645 contractors were required to submit to background checks at BMW's facility in Spartanburg, South Carolina after BMW switched contract companies at its plant.
Though the 88 persons who were not rehired by the new contractor all had criminal records, that may not necessarily be a legal way to screen applicants, as the EEOC counters: "BMW's policy has no time limit with regard to convictions. The policy is a blanket exclusion without any individualized assessment of the nature and gravity of the crimes, the ages of the convictions, or the nature of the claimants' respective positions."
BMW's actions were in violation of the Civic Rights Act of 1964, according to the EEOC, because they utilized "a criminal conviction policy that disproportionately screened out African-Americans." A recent bulletin offering guidance from the EEOC on the Civil Rights Act can be found here, but the EEOC's stance on the issue has been the same for years: "Since issuing its first written policy guidance in the 1980s regarding the use of arrest and conviction records in employment decisions, the EEOC has advised employers that under certain circumstances, their use of that information to deny employment opportunities could be at odds with Title VII."

Daimler, Toyota, BMW to lead $10-billion hydrogen investment

Daimler, BMW, and Toyota are leading a group of 13 companies pledging to invest more than $10 billion during the next five years to spur enough infrastructure-building and technology advancements to get more of the general public to buy hydrogen fuel-cell vehicles. The automakers, which also include Honda and Hyundai, as well as companies such as Shell, AirLiquide, Linde Group, and Total SA, are part of what they're calling the Hydrogen Council. The group made its announcement in Davos, Switzerland, on Tuesday. The Hydrogen Council will pledge to accelerate its rate of hydrogen-related investments, which currently stand at about $1.5 billion annually. The coalition says its work represents a continuation of the 2015 Paris Agreement, in which many of the companies agreed to address the issue of climate change. The group says that hydrogen, which emits water vapor when used in fuel-cell vehicles, "can play an important role in the transition to a clean, low-carbon, energy system." The Hydrogen Council also vowed to push global governments to accelerate public investment in hydrogen-related infrastructure. Relative to other drivetrain technologies, hydrogen fuel-cell vehicles are in their relative infancy in terms of adoption because of the high cost of both building fuel cell vehicles and setting up a hydrogen-refueling infrastructure. Toyota is the only automaker that sells a production fuel-cell vehicle in the US. The Japanese company, which introduced its Mirai domestically in late 2015, sold 1,034 of them in the US last year. Daimler subsidiary, Mercedes-Benz, used Tuesday's announcement to remind people that it would start selling its GLC plug-in hydrogen fuel-cell crossover this year. There are only 33 publicly accessible hydrogen refueling stations in the US, including 30 in California, and one each in Connecticut, Massachusetts, and South Carolina, according to the US Department of Energy. By comparison, there are more than 15,000 electric-vehicle charging stations with almost 40,000 outlets in the US. 2014 BMW 4 Series drops its top, priced from $48,750*

BMW will debut its new 2014 4 Series Convertible at the Los Angeles Auto Show in November, and after seeing plenty of spy shots and, most recently, some leaked images, we now have all the official details. To no one's surprise, the 4 Series convertible is, essentially, a topless version of BMW's new-for-2014 4 Series coupe, and will be offered in the United States in the same 428i and 435i guises.
On the base end, that means the 428i Convertible arrives with the company's 2.0-liter turbocharged inline four-cylinder engine, good for 240 horsepower and 255 pound-feet of torque, and available with either rear- or all-wheel drive. BMW says the 428i will sprint to 60 miles per hour in a respectable 6.2 seconds. For folks in need of more thrust, BMW will happily sell you a 435i Convertible, available only with rear-wheel drive, powered by a 3.0-liter, twin-turbocharged inline-six that produces 300 hp and 300 lb-ft of twist. Hitting 60 mph in the 435i will take roughly five and a half seconds with the standard eight-speed auto. Curiously, BMW did not mention anything about a six-speed manual transmission for either model, so looks like this droptop might be an auto-only affair. We've contacted BMW for confirmation, so we'll keep you posted.
Like the 3 Series Convertible it replaces, the 4 Series uses a three-piece folding hardtop configuration, and BMW says that added sound deadening reduces audible wind noise by about two decibels. Folding the automatic roof takes just 20 seconds, and can be done at speeds up to roughly 11 mph. For chilly, top-down driving (something we're big fans of), there are now three-temperature neck warmers for the front seats - just like what Mercedes-Benz offers with its AirScarf system.
