BMW to pay $1.6M, rehire workers in discrimination settlement

A BMW subsidiary is on the hook for $1.6 million and must rehire workers as part of a settlement for a race discrimination lawsuit with the US Equal Employment Opportunity Commission. A change in BMW Manufacturing's criminal background check policy at the Spartanburg, SC, factory disproportionately affected African American workers, according to the EEOC, and it cost many people their jobs. The automaker has since changed the policy. According to Automotive News, the suit stemmed from BMW switching logistics contractors at the plant in 2008. As a result, 645 existing workers had to submit revised criminal background checks to keep their jobs. About 100 people didn't meet the new guidelines, according to the EEOC, and they lost their jobs. Around 80 percent of those affected were African American. According to the government agency's complaint, the altered procedures only took into account the category of a crime, not factors like when it occurred or whether the infraction was a misdemeanor or felony. With the settlement accepted by US District Court, BMW must offer work to the affected employees in this case and as many as 90 African American applicants that the contractor didn't hire because of the rules. The automaker also must offer training in the proper manner for criminal background checks. While there's nothing inherently wrong with investigating workers, "when a criminal background screen results in the disproportionate exclusion of African-Americans from job opportunities, the employer must evaluate whether the policy is job related and consistent with a business necessity," P. BMW Recalls 1.6 Million 3 Series Cars For Air Bag Problem

DETROIT (AP) - BMW is expanding a recall of its most popular models to fix an air bag problem that is hitting much of the global auto industry. The German automaker says it will recall 1.6 million 3 Series cars from model years 2000 to 2006 across the world, including 574,000 in the U.S. The company said Wednesday that it's a precaution because other automakers using similar systems have reported problems. Air bag inflators in systems made by Takata Corp. can rupture. If that happens, the bags might not work properly, and shards could fly out and cause injury or death. The problem is responsible for millions of recalled vehicles during the past few years made by manufacturers such as Chrysler, Ford, Honda, Mazda, Nissan and Toyota. Here's a look at the long history associated with this problem, that affects millions of cars. BMW said it has no reports of problems in its vehicles. Dealers will replace the passenger-side front air bags. The new recall excludes 42,000 BMWs recalled in May 2013 for the same problem. The company says it is recalling all vehicles equipped with potentially faulty air bag systems regardless of where they were sold. In June, the U.S. National Highway Traffic Safety Administration began investigating air bags made by Takata, a Tokyo-based supplier of seat belts, air bags, steering wheels and other auto parts. The agency said it received six reports of air bags rupturing in Florida and Puerto Rico. Three people were injured in those cases. It had estimated 1.1 million vehicles in the U.S. could be affected, but the total is likely to climb. The government says it wanted to act quickly in warm states while it continues to investigate the issue. "Based on the limited data available at this time, NHTSA supports efforts by automakers to address the immediate risk in areas that have consistently hot, humid conditions over extended periods of time," the agency said in a statement. Takata said in a statement Tuesday that it is supporting the NHTSA investigation and its customers with technical analysis and replacement parts. VW could look outside its own ranks for next CEO

Companies have two options when coming up with succession plans – hire within, or go outside its ranks. Either choice comes with advantages and disadvantages, to be sure. Hiring within means generally getting someone familiar with the company and its culture and traditions, while going outside is ideal if you're looking to shake things up and bring in fresh ideas. It's unclear which avenue the Volkswagen Group will go down when it comes time to replace its head man, Herr Professor Doctor Doctor Herr Martin Winterkorn, but he isn't ruling out a trip outside of Wolfsburg. Winterkorn has already given the reins of the VW brand to former BMW board member Herbert Diess, while Andreas Renschler, a former Daimler board member, is heading up VW's truck group. Now, Winterkorn has made some statements to a German weekly that indicate the most important thing about his successor isn't necessarily his (or her, though no women appear to be on the short-list) previous employer, Motoring.com.au is reporting, so much as his qualities as a leader and an engineering background. "A Volkswagen boss has to have a big affinity to our products. He needs to be close to customers and he needs to have a relationship with dealers," Winterkorn told Stern. "Like always, it depends on the personality and it also helps if the candidate is an engineer." Motoring throws out a couple of potential candidates from within, including Porsche boss Mathias Muller, Audi Chairman Rupert Stadler and engineering guru Ulrich Hackenberg, in addition to both Diess and Renschler. And while each candidate has a lot of potential, the only thing that's guaranteed right now is what Winterkorn has already said: "The decision about who will succeed me is not an easy one for the supervisory board."
