BMW to pay $1.6M, rehire workers in discrimination settlement

A BMW subsidiary is on the hook for $1.6 million and must rehire workers as part of a settlement for a race discrimination lawsuit with the US Equal Employment Opportunity Commission. A change in BMW Manufacturing's criminal background check policy at the Spartanburg, SC, factory disproportionately affected African American workers, according to the EEOC, and it cost many people their jobs. The automaker has since changed the policy. According to Automotive News, the suit stemmed from BMW switching logistics contractors at the plant in 2008. As a result, 645 existing workers had to submit revised criminal background checks to keep their jobs. About 100 people didn't meet the new guidelines, according to the EEOC, and they lost their jobs. Around 80 percent of those affected were African American. According to the government agency's complaint, the altered procedures only took into account the category of a crime, not factors like when it occurred or whether the infraction was a misdemeanor or felony. With the settlement accepted by US District Court, BMW must offer work to the affected employees in this case and as many as 90 African American applicants that the contractor didn't hire because of the rules. The automaker also must offer training in the proper manner for criminal background checks. While there's nothing inherently wrong with investigating workers, "when a criminal background screen results in the disproportionate exclusion of African-Americans from job opportunities, the employer must evaluate whether the policy is job related and consistent with a business necessity," P. Think the only challengers for the title of best-selling luxury brand hail from der Vaterland? Wrong. Lexus outsold the likes of Mercedes-Benz for the second time in 2014 last month. In fact, the Japanese luxury marque's total sales this year are a mere 12,000 units behind BMW.
Lexus was able to move 26,921 vehicles last month, a year-over-year increase of 21.1 percent, respectively. Mercedes, meanwhile, was just barely beaten, moving 26,617 units in April. The difference, though, is that Lexus has made far bigger year-over-year gains than Mercedes, which recorded a YOY increase of just 4.13 percent.
This is particularly troubling for the Germans, as it marks a return to form for Lexus that we haven't seen since before the March 2011 earthquake and tsunami that decimated Japan. Prior to that natural disaster, Lexus enjoyed nearly a dozen years at the top of the luxury heap.

Comparing Nürburgring Nordschleife lap times is a bit of a black art, especially when looking at times officially set by manufacturers matched against other sources. Driver skill and weather conditions play a huge roll in determining a quality time. Still, it appears BMW fans have reason to celebrate because the new M4 Coupe beat the previous-generation M3 by 13 seconds in a recent test by Germany's Sport Auto magazine.
Sport Auto conducts what it calls the Supertest, where it runs performance cars around the 'Ring and the short course at Hockenheim to create its own database of comparable times. The M4 with a dual-clutch transmission, ceramic brakes and Michelin Pilot Supersport tires managed a quality 7 minutes 52 second lap around the 12.8-mile course, compared to 8:05 from the last M3, according to BimmerPost. The new coupe also beat the magazine's posted times for the Audi RS5 Coupe, which did it in 7:59, and Mercedes-Benz C63 AMG with an 8:01, but couldn't quite match the 7:44 set by a 911 Carrera S. Still, BMW must be somewhat pleased with these results of its new 425-horsepower coupe because it posted the magazine's cover and an image of the time on its official M Facebook page.
While the M4 apparently stands up to contemporaries and predecessors, new generations of the AMG and RS models are reportedly on the horizon. In other words, more tests will come.
