Angry diesel owners joining lawsuits against Volkswagen [w/video]

Livid at the prospect of losing thousands of dollars from the value of their cars and performance from their diesel engines, many owners of Volkswagens are headed to court. A law firm with a track record of suing automakers has already filed three class-action lawsuits against the German automaker related to its emissions-cheating scandal and says a fourth one is on the way. The lawsuits, filed by national firm Hagens Berman, accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Plaintiffs in all 50 states have joined the class-action suits, according to the firm. A spokesperson says there has been "an unprecedented response" since the first lawsuit was filed within hours of an announcement from federal regulators last Friday. The lawsuits accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Diesel owners paid thousands more for their vehicles instead of their gasoline-powered counterparts because Volkswagen's diesel engines ostensibly offered both torque and fuel economy. Now affected car owners are faced with a double-whammy – the value of their cars has diminished with the news and the purported software fix that brings the cars in emissions compliance will likely lower their performance and gas mileage. "Hundreds of thousands of consumers put their trust in VW when they looked to its 'Clean Diesel' line for an efficient, environmentally conscious diesel option," said Steve Berman, managing partner. "But for years, VW cheated the system. Its TDI line of fast but 'good-for-the-environment' cars seemed too good to be true, and they were." In its latest court filing, Hagens Berman lawyers said that car owners believed their vehicles were in compliance with Environmental Protection Agency standards and that the cars would retain their operating characteristics throughout their useful lives. Another firm, Girard Gibbs, has also filed a lawsuit over the diesel deception. "These Volkswagen vehicles should never have been sold, and certainly should not have spent the past six years on American roads polluting our air," said Eric Gibbs, the lead attorney. "Not only does this kind of fraud harm consumers and the environment, it negatively impacts competition, which is what drives our free-market system.

German authorities investigate Winterkorn

Former Volkswagen CEO Martin Winterkorn is potentially walking away from the embattled automaker with a $32-million pension, but his retirement might not be quite so relaxed because German prosecutors in the city of Braunschweig (also called Brunswick) are now investigating his role in VW's diesel emissions evasion. The lawyers want to know whether he committed fraud, and a conviction could mean up to 10 years in prison, according to the Associated Press. However, this process is still in its earliest stages, and Winterkorn is long way from sitting in a courtroom. With other high-profile corporate cases in Germany as a guide, a trial could be years away. Lawyers haven't even questioned the former CEO, yet. In Germany, people are free to file criminal complaints, and prosecutors then decide whether a full investigation is necessary. According to the AP, Braunschweig has received about 12 grievances so far, including one from Volkswagen. The law in the country also doesn't allow charging businesses with wrongdoing, only people. Winterkorn resigned from his role at the top of VW last week, just a day after issuing a video apology for the automaker's actions. Former Porsche boss Matthias Muller has succeeded him. Along with having a new person in charge, the automaker's Supervisory Board instituted a thorough corporate reshuffle to put more focus on various regions and give brands additional power by early next year. Watch Chris Harris in the electric VW ID.R waste a McLaren 720S

The Volkswagen ID.R doesn't have much in common with a McLaren 720S, other than the fact that they are both performance-crazed cars. One gets its power from batteries, the other from gas. One uses electric motors, the other a twin-turbocharged 4.0-liter V8. One is a halo prototype vehicle, the other is a road-legal supercar available for purchase. So when Chris Harris and "Top Gear" decided to "race" the two against each other, it was more of a demonstration of the VW's unreal capabilities than any sort of real competitive faceoff. In episode five of Top Gear's 28th season, which just aired February 23, the trio of Harris, Freddie Flintoff and Paddy McGuinness welcomed Youtuber KSI on the show and ventured out on a luxury sports car road trip with an Aston Martin, Porsche, and Ferrari. Separately, Harris took to the track to test out Volkswagen's golden egg of the moment, the ID.R. As VW fully launches into its electric-vehicle push, the ID.R is meant to exhibit what battery-electric technology is capable of. With two electric motors, one on the front axle and one on the rear axle, the 2,425-pound ID.R has four-wheel drive and makes a claimed 670 horsepower. As Harris notes in the video, the ID.R. was not built for a specific regulation-bogged racing organization or competition, and thus, it's only held back by the rules of Mother Nature and Father Physics. Since the car's debut, it has been annihilating records around the world, including at Pike's Peak, Goodwood, the Nurburgring, and Heaven's Gate. Chris Harris didn't set any records in the ID.R., but he certainly showed how outrageous this machine is. The 710-horsepower 720S can go from zero mph to 62 mph in less than three seconds, and the ID.R has a sizable lead within that same time. Again, this wasn't an instance of test-and-conclude, it was a show of perspective. The ID.R is a race car, so even though the 720S is one of the best supercars in the world, it never stood a chance.
