U.S. opens probe into whether VW vehicles infringe Jaguar Land Rover patents

WASHINGTON — The U.S. International Trade Commission (ITC) said on Monday it is opening in investigation into whether Volkswagen AG infringed on patents held by Jaguar Land Rover for a system used for off-road driving. In November, Jaguar Land Rover, a unit of Tata Motors, filed a complaint with the ITC seeking to prevent the import of some VW Porsche, Lamborghini and Audi models with "certain vehicle control systems" that allegedly infringe on it patents held for its Terrain Response system. The models include the Lamborghini Urus, Porsche Cayenne and AudiÂ’s Q8, Q7, Q5, A6 Allroad, and E-Tron vehicles and the VW Tiguan. The ITC said it has made no decision on the merits. VW said in a statement it was examining the action and determining its next steps. "We will of course cooperate with investigating authorities. While we cannot comment on any details of the proceedings, we strongly believe that the claims have no merit and will robustly defend our position," VW said. Many automakers offer a suite of off-road powertrain controls, but JLR claims Volkswagen's tech is more than just similar.  Jaguar Land Rover (JLR) said the vehicles "have used JLRÂ’s patented inventions without payment or permission" notably a patent for an "improved system for driving a vehicle on different driving surfaces, in particular off-road." JLR says its Terrain Response technology uses the patented technology to maximize performance on off-road driving surfaces, including grass, snow, mud, sand and rocks.

VW confirms Audi's emissions test transmission anomalies

Just a week after reports that the California Air Resources Board (CARB) found an emissions cheat in some Audi automatic transmission software programs, parent company Volkswagen has come clean. As reported by Reuters, VW's response to an article by Munich's Sueddeutsche Zeitung stated that the adaptive shift functionality can "lead to incorrect and non-reproducible results." Adaptive shift programs alter the characteristics of a vehicle's transmission to suit different driving styles. Gentle driving will result in earlier shifts and lower engine revs, while hard-charging on the pedals and steering will make the transmission more responsive and hold gears longer. That adaptation can change over time or even on a short-term basis. And it can save fuel. The difference in this case is that is seems that the Audi transmissions were specifically programmed to detect emissions test conditions. As we explained in a previous article, one of those test conditions is keeping the wheel straight. Turning more than 15 degrees shuts the test mode off. According to Reuters, the US government is trying to determine whether this classifies as an emissions cheat device, although VW, Audi, and the EPA have not commented on the record. Volkswagen drops "GTi" lawsuit against Suzuki

Way back in 2004, Volkswagen took umbrage with Suzuki being granted permission to use the nameplate "SWIFT GTi" for a performance variant of its small-car offering (2012 equivalent seen here). Now, eight years and surely some very steep legal bills later, VW has finally dropped its claim against Suzuki.
The General Court of the European Union stated, back in March of this year, that Suzuki's GTi registration could not be confused with VW's "Golf GTI." Volkswagen had appealed that ruling, though has now reportedly called off the dogs. In fact, Germany's Die Welt reports that the appeal has been dead for several weeks now.
This news comes amongst continued arbitration acrimony between the two automakers, all revolving around VW's forced divestiture of nearly 20-percent stake it purchased in Suzuki some two years ago.
