US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

Most stunning was the speed of it all. On the morning of September 18, Volkswagen AG stood atop the automotive world. It was profitable and sold more cars than Toyota and General Motors, its two main rivals for global supremacy. By nightfall, the company would be embroiled in scandal. Revelations the German auto giant cheated on diesel emissions testing in the United States reverberated from Washington to Wolfsburg, Germany. What started out as a problem with 482,000 VWs and Audis in the US exploded into an international scandal. Millions of vehicles have the rigged software, meaning VW broke environmental rules as its cars spewed pollutants all over the world. The fallout began immediately. Volkswagen CEO Martin Winterkorn – one of the most respected and capable executives in the business – apologized on Sunday and Tuesday. On Wednesday he resigned. As the week progressed, the company's stock took a beating and credit agencies threatened to drop their ratings. VW dealers and owners said they felt betrayed. The automaker hired a law firm that defended BP after the Deepwater Horizon oil spill. The EPA is already extending its testing procedures to look for "defeat devices" like the ones used by Volkswagen. On Friday the company announced a major restructuring. Matthias Muller, Porsche's chief for the last five years, took over as CEO of Volkswagen and is charged with picking up the pieces of a shattered company facing regulatory action and lawsuits. With GM, Toyota, and Takata scandals still fresh, Volkswagen will likely experience unprecedented levels of scrutiny. Additionally, VW's markets in the United States, Canada, and Mexico will be combined into a North American region under the leadership of former Skoda boss Winfried Vahland, though US chief executive Michael Horn will stay on. The company is also realigning its brands by specialty and streamlining its board. Firings, government action, restructurings, and international outrage – things that usually build up over months or years – all occurred in about a week. With dizzying speed, Volkswagen's future has changed dramatically. It all happened, it's still happening, so fast. Recharge Wrap-up: Arcimoto SRK video, BAIC EV at CES

Kelley Blue Book took a spin in the Arcimoto SRK three-wheeled EV at CES in Las Vegas. In the video above, KBB Managing Editor Micah Muzio gets behind the handlebars for a spin around an empty parking lot. He notes a gradual throttle tip-in, though from the video, it appears the trike has a bit of pep. While the hydraulic brake pedal requires a bit of extra effort, the regenerative brake lever located on the right handlebar is effective and easy to use. The steering is a little heavy, but manageable, at low speeds. He calls it "kind of a fun little conveyance," adding, "Maybe this is the future." See the full review in the video above. CARB Chairman Mary Nichols spoke with German television about Volkswagen's emissions scandal. In a photo she posted on Twitter, Nichols can be seen in front of cameras with CARB's test bay in the background. In the bay is a Volkswagen Jetta TDI. She says in her tweet, "Discussing VW cheating case w/German TV in front of ARB lab test bay & '07 diesel Jetta. Time to move on to #EVs!" Late last year, a group of environmentalists and Silicon Valley leaders – Elon Musk included – sent Nichols an open letter suggesting CARB help urge Volkswagen to give up on diesels and focus on electric vehicles. See Nichols's post on Twitter. South Korea's most popular EV is the Renault Samsung Motors (RSM) SM3 ZE (also known as the Renault Fluence ZE). The all-electric vehicle has sold 1,767 units since its arrival in Korea since November 2013, with 2015 sales reaching 1,043 units. This makes one in three EVs in Korea a RSM SM3 ZE. The car has been selected as Korea's official government vehicle, and RSM has supplied over 100 EV taxis, 60 of which are in Seoul. Read more in the press release from Renault. BAIC EV announced it has established an R&D center in Detroit at CES. It will work with its other centers in Silicon Valley and Aachen, Germany in order to develop automotive technology and evaluate global demand. The EV branch of the Chinese automaker also debuted its i-Link information system, which uses 4G to connect car telematics to the cloud. The i-Link system also provides wireless phone charging, remote inquiry services and connects sensing technologies to the internet. Read more in the press release below.
