West Virginia sues VW for fraud, asks for major financial penalty

It took just four researchers, including two students, at West Virginia University doing some emissions tests eventually to engulf Volkswagen in an international scandal that has been raging for weeks. Now, the state's attorney general Patrick Morrisey has filed a formal complaint against the automaker's US branch for violating the West Virginia Consumer Credit and Protection Act. His argument alleges that VW "fraudulently manufactured, advertised, and sold" these polluting diesel vehicles as being good for the environment. If the West Virginia case is successful, VW could be on the hook for serious monetary punishment. Morrisey asks that any consumers in the state get refunds totaling the premium paid over a gasoline model, the loss in resale value, and the expected costs of lost performance from the upcoming recall repair. On top of that, the automaker would pay the state $5,000 for each violating vehicle and all of the related costs for preparing for the trial. According to the complaint's legal documents (here, as a PDF), the state's DMV currently shows 2,684, diesel 2009-2015 VW vehicles registered there. Morrisey isn't the only state attorney general to take a stern look at VW's actions, and his counterparts in at least 29 other states are investigation similar courses of action, as well. In addition, the Department of Justice and Environmental Protection Agency have their own probes underway. The final result could be very expensive for the automaker. (Volkswagen), alleging the business violated the West Virginia Consumer Credit and Protection Act. The complaint alleges that Volkswagen fraudulently manufactured, advertised and sold a line of "clean diesel" vehicles with Turbo-charged Direct Injection (TDI) engines. "Volkswagen allegedly knowingly engineered certain vehicles to cheat U.S. emissions tests," Attorney General Morrisey said. "That is one reason why we have filed this complaint." A May 2014 study conducted by the Center for Alternative Fuels, Engines & Emissions at West Virginia University found elevated levels of emissions on several Volkswagen cars. Their data was then turned over to the U.S. Environmental Protection Agency (EPA) and the California Air Resources Board.

VW to pay $1B in settlement with US government over V6 diesels

Volkswagen and the US government have come to a settlement for the civil claims against the automaker's 3.0-liter, diesel V6s. Over 83,000 V6 TDI-powered models are currently prowling US roads in violation of emissions laws. The settlement allows VW to recall over 75 percent of its cheating V6 diesels – about 63,000 units – and bring them into compliance. These represent newer VW Touaregs, Audi A6, A7, A8, Q5, and Q7s, and Porsche Cayennes built between 2013 and 2016. According to the company, the recall will bring these so-called Generation Two engines up to emissions specs, provided the EPA and CARB okay the modifications. Should the regulators say no to VW's tweaks, the company will buy back or terminate leases with the affected owners. For older V6 TDIs built between 2009 and 2012, Volkswagen will do broadly the same thing, only in reverse. It will lead with buy backs of older Touaregs and Q7s – the only vehicles the company sold with the earlier engines – but could offer fixes if EPA/CARB give the okay. As part of its agreement over the emissions-cheating V6s, Volkswagen will contribute $225 million to the "environmental remediation trust" it established as part of its settlement over cheating 2.0-liter TDIs. VW is also on the hook for $25 million with CARB, bringing the total for the six-cylinder part of its emissions cheating scandal to around $1 billion, Automotive News reports. But few (this is side of his steamers, anyway) have been as slow – or quite as beautiful – as this classic 1966 Volkswagen Samba. While many of the vehicles featured on episodes of Jay Leno's Garage have actually been from Jay Leno's own garage, the former talk-show host has been known to feature some interesting rides from fellow comedians. A couple of weeks ago it was Adam Carolla's '68 Lamborghini Islero, and this vintage, pristine VW bus belongs to Gabriel Iglesias. It's in beautiful condition and is a sight to see, even if it has a little trouble making its way down the highway. Or starting up again after a quick snack break.
