West Virginia sues VW for fraud, asks for major financial penalty

It took just four researchers, including two students, at West Virginia University doing some emissions tests eventually to engulf Volkswagen in an international scandal that has been raging for weeks. Now, the state's attorney general Patrick Morrisey has filed a formal complaint against the automaker's US branch for violating the West Virginia Consumer Credit and Protection Act. His argument alleges that VW "fraudulently manufactured, advertised, and sold" these polluting diesel vehicles as being good for the environment. If the West Virginia case is successful, VW could be on the hook for serious monetary punishment. Morrisey asks that any consumers in the state get refunds totaling the premium paid over a gasoline model, the loss in resale value, and the expected costs of lost performance from the upcoming recall repair. On top of that, the automaker would pay the state $5,000 for each violating vehicle and all of the related costs for preparing for the trial. According to the complaint's legal documents (here, as a PDF), the state's DMV currently shows 2,684, diesel 2009-2015 VW vehicles registered there. Morrisey isn't the only state attorney general to take a stern look at VW's actions, and his counterparts in at least 29 other states are investigation similar courses of action, as well. In addition, the Department of Justice and Environmental Protection Agency have their own probes underway. The final result could be very expensive for the automaker. Attorney General Patrick Morrisey Files Complaint Against Volkswagen of America, LLC 10/5/2015 CHARLESTON — Attorney General Patrick Morrisey announced today that his Office filed a complaint against Volkswagen of America, Inc. (Volkswagen), alleging the business violated the West Virginia Consumer Credit and Protection Act. The complaint alleges that Volkswagen fraudulently manufactured, advertised and sold a line of "clean diesel" vehicles with Turbo-charged Direct Injection (TDI) engines. "Volkswagen allegedly knowingly engineered certain vehicles to cheat U.S. emissions tests," Attorney General Morrisey said. "That is one reason why we have filed this complaint." A May 2014 study conducted by the Center for Alternative Fuels, Engines & Emissions at West Virginia University found elevated levels of emissions on several Volkswagen cars. Their data was then turned over to the U.S. Environmental Protection Agency (EPA) and the California Air Resources Board.

VW recognizes second union at Chattanooga plant

The ongoing story of organizing workers at Volkswagen's factory in Chattanooga, TN, continues to get more complicated. Following an independent audit, the automaker has now recognized a second union at the plant called the American Council of Employees. The group was founded there last year to offer an alternative to the United Auto Workers. "I'm not anti-union. I understand that a properly run union can benefit people. We will be that union," Sean Moss, president of the ACE, said to Reuters, according to Automotive News. The group claims to represent at least 15 percent of the workers at the plant. Acceptance of the ACE has led to an interesting situation in Chattanooga because VW also recognized the UAW at the factory in December 2014, and the group has claimed to represent at least 45 percent of workers there. According to Automotive News, each union has access to management, but the UAW has more because of its larger contingent of supporters. However, neither organization has a collective bargaining agreement with the automaker. Moss may have a rough time increasing support among employees at the factory. According to Automotive News, many anti-UAW workers there are completely against unions in general. Getting these folks to join his group isn't an easy task. The UAW has been working to fully represent the VW factory for years. However, the group lost a vote to do so in 2014. It eventually created a union local there to try to build support. All of the effort comes ahead of a $900 million plant expansion to add about 2,000 jobs and build a new crossover in Tennessee. Aurora's Chris Urmson on autonomy — that's one way to avoid speeding tickets

Although this year's CES was full of companies announcing and exhibiting their real and conceivable self-driving car technologies, while actual self-driving cars from Aptiv-Lyft were giving conventioneers 400 rides around town, the biggest news came when Volkswagen Group — and recognize this is the entire group, not just the brand — and Hyundai announced that they'd both partnered with Aurora Innovation. While the VW announcement was vague — "The collaboration brings the two companies together to realize self-driving electric vehicles in cities as Mobility-as-a-Service (MaaS) fleets" — Hyundai provided a concrete goal: "a strategic partnership to bring self-driving Hyundai vehicles to market by 2021." You may not have heard of Aurora, which has been described in some news accounts as "mysterious." But Aurora Innovation has been in business since December 2016, and it is to autonomous technology what the 1927 Yankees are to baseball. The three leaders of the company are Chris Urmson, co-founder and CEO, who had previously been chief technology officer for Alphabet Self-Driving Cars; Sterling Anderson, co-founder and chief product officer, who had directed the development of Tesla Autopilot; and Drew Bagnell, co-founder and chief technical officer, who had been autonomy architect and perception lead at the Uber Advanced Technology Center. We had the chance to sit down with Chris Urmson after he appeared onstage at a Hyundai press conference. He shared his insights on Aurora's approach to automated driving. Initial deployment of self-driving cars? "We think the first place this technology comes to market in in the transportation services or ride-hailing applications, but that's for our partners to decide." (Ride-sharing is a strategy a lot of players in the field are shooting for, as round-the-clock use is one way for paying for what will initially be a technology too costly for private ownership.) Transporting goods or people? "I personally — and as a company — am more excited initially about moving people around. Urban mobility. That's where you see the largest social impact. And it provides better access to mobility for people." Can you create a car that doesn't crash? "It is a fundamentally hard problem because other operators on the road can behave erratically at any moment. For example, if you are in a two-lane, opposing-traffic road, if you want to be safe, you don't drive there, ever.
