Automakers agree to clean up diesels to avoid ban in German cities

BERLIN -- Auto industry officials and politicians in Germany have agreed to clean up diesel vehicles through software updates as part of a rescue plan for avoiding diesel bans in cities, industry and government sources said on Friday. The costs of the rescue plan amount to under 2 billion ($2.33 billion) euros for cars in Germany, with the auto industry agreeing to shoulder the expense of about 100 euros per car, the sources said. After Volkswagen Group confessed to emissions-test cheating in 2015, the entire auto industry has come under scrutiny for producing nitrogen oxide emissions in diesel cars, which are blamed for causing respiratory disease. Audi, a division of Volkswagen Group, said it would update engine software on up to 850,000 diesel cars. The refit of six and eight cylinder engines will be free of charge for all customers, Audi said. The service will also be offered to Porsche- and Volkswagen- branded cars using the same six- and eight-cylinder engines, Audi said. Earlier this week, Porsche's CEO was quoted as saying the brand may abandon diesel engines as its electric cars go to market, and Mercedes announced a plan similar to Audi's, in which it will recall 3 million diesel cars in Germany for a $255 million engine software fix. Diesel cars from all domestic and foreign car brands that conform to the latest emissions standards, Euro-6 and Euro-5, will be updated, the sources said. The plan is set to be presented at the beginning of August. With the software updates, the auto industry is able to cut nitrogen oxide pollution by about 20 percent, the sources said. A committee will be set up to measure the impact of updating diesel cars on individual communities and cities, with a view to averting bans of diesel cars, the sources said. VW reaches out to diesel consumers with new website

Volkswagen is starting to get details out to the public about its diesel emissions evasions in the US, and the automaker now has a dedicated website for consumers. The first thing that visitors see is an apology video from Volkswagen Group of America CEO Michael Horn. The site also details all of the VW TDI's currently known to be affected here, including the 2009-2015 Jetta, 2009-2014 Jetta SportWagen, 2010-2015 Golf, 2015 Golf SportWagen, 2012-2015 Beetle and Beetle convertible, and 2012-2015 Passat. Although, the Audi A3 should be on there, too. The company repeatedly reassures owners that these vehicles are safe to drive and promises it's developing a fix as quickly as possible to make them emissions compliant. On the site's FAQ, VW also clarifies that there's still a stop-sale on all of these models with the 2.0-liter TDI, including certified pre-owned ones. That could change soon because the automaker believes that the 2016 model year examples are legal, but the Environmental Protection Agency needs to sign off before they could go to dealers. Until the diesels can be sold, there also won't be any TDI advertising by VW. "We are working at full speed on a technical solution that we will present to partners, to our customers and to the public as swiftly as possible," Herbert Diess, CEO of Volkswagen passenger car division, says in a statement. He also offers an improved accounting of the number of vehicles affected. VW had previously said that there were 11 million with the emissions evading software worldwide. According to Diess, around five million of these came from the VW brand. Audi has said there about 2.1 million of its models affected globally with between 13,000 and 14,000 in America. DR. Livid at the prospect of losing thousands of dollars from the value of their cars and performance from their diesel engines, many owners of Volkswagens are headed to court. A law firm with a track record of suing automakers has already filed three class-action lawsuits against the German automaker related to its emissions-cheating scandal and says a fourth one is on the way. The lawsuits, filed by national firm Hagens Berman, accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Plaintiffs in all 50 states have joined the class-action suits, according to the firm. A spokesperson says there has been "an unprecedented response" since the first lawsuit was filed within hours of an announcement from federal regulators last Friday. The lawsuits accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Diesel owners paid thousands more for their vehicles instead of their gasoline-powered counterparts because Volkswagen's diesel engines ostensibly offered both torque and fuel economy. Now affected car owners are faced with a double-whammy – the value of their cars has diminished with the news and the purported software fix that brings the cars in emissions compliance will likely lower their performance and gas mileage. "Hundreds of thousands of consumers put their trust in VW when they looked to its 'Clean Diesel' line for an efficient, environmentally conscious diesel option," said Steve Berman, managing partner. "But for years, VW cheated the system. Its TDI line of fast but 'good-for-the-environment' cars seemed too good to be true, and they were." In its latest court filing, Hagens Berman lawyers said that car owners believed their vehicles were in compliance with Environmental Protection Agency standards and that the cars would retain their operating characteristics throughout their useful lives. Another firm, Girard Gibbs, has also filed a lawsuit over the diesel deception. "These Volkswagen vehicles should never have been sold, and certainly should not have spent the past six years on American roads polluting our air," said Eric Gibbs, the lead attorney. "Not only does this kind of fraud harm consumers and the environment, it negatively impacts competition, which is what drives our free-market system.
