US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The van is currently a broken-down heap with the interior a mess, but the title and registration proves Dr. Kevorkian's ownership. The pawnbroker is hoping to get $40,000 for the ghoulish ride, according to an interview with Fox 2 News. If you're unfamiliar, Dr. Kevorkian rose to prominence in the '90s when he helped with 130 assisted suicides. It earned him the nickname Dr. Death, and he was eventually convicted of second-degree murder in 1999, serving eight years in prison. He died in 2011. Kevorkian's VW has had quite a history. The van was reportedly due to be destroyed in 1997 but somehow avoided the crusher. A retired VW parts dealer put the bus on eBay in 2010, but the vehicle was removed for violating the site's policy against selling "murderabilia." The VW eventually went to auction, but this report said that it hasn't moved in over two years. It is diminutive of stature, as you can see in the photo, measuring 153.1 inches long, 65.6 inches wide, and just 45.4 inches tall. It is being billed as the world's most efficient production car, but it's unlikely Dr. Malorny will be making his money back on fuel savings any time soon; despite the first sale and the vehicles appearing on the German VW site, Volkswagen has not officially announced the price tag for the XL1.
