VW diesel incentives could be fuel for prosecutors

In the 2000s, Volkswagen was among the companies that lobbied the government to get buyers of diesel vehicles a tax credit. The automaker even brought some of these models to Washington to show them to politicians. The incentive eventually passed, and about 39,500 customers of the 2009 Jetta TDI and Jetta SportWagen TDI got a $1,300 benefit – for a total cost of around $51 million. Now, according to Reuters, that politicking might come back to bite the automaker when prosecutors finally get cases to trial. The US Department of Justice, the Environmental Protection Agency, and attorneys general in at least 29 states are already investigating VW, and politicians are pushing for criminal and civil actions against the company. According to Reuters, there could be several legal routes available, too. One option is to bring tax fraud charges, and that would require proving the automaker knew it was making untrue claims about the diesel models. There's also the option of bringing a case under the False Claims Act, which prohibits fraud against the government. According to Reuters, a maximum penalty under the law would be three times the tax credit and another $5,000 for each vehicle that received it. The company is also facing a class-action lawsuit from disgruntled owners. To aid its defense against all of these claims, VW has hired the same firm that worked with BP during the Deepwater Horizon oil spill. Outside of the US, prosecutors in Germany have just started to build a case against former CEO Martin Winterkorn for alleged fraud. In addition to these potential legal penalties, VW could be fined around $18 billion by the EPA for the emissions infractions. The agency's investigation is getting the added backing of its Canadian counterpart. Although, the actual settlement is expected to be far less.

Chevrolet has delivered about 200 units of its bi-fuel Impala so far. The automaker originally planned to begin sales in summer of 2014, but was delayed over a year due to quality concerns. Now, the bi-fuel Impala, which runs on both gasoline and CNG, has begun delivery, mostly to commercial and fleet customers. The car begins at $38,210 (including destination charges), and will be available at 3,200 US dealerships. Production of a 2016 model is underway. Read more at Green Car Reports. The US Department of Energy (DOE) has announced $35 million in funding for hydrogen and fuel cell technology projects. The money will support research and development, manufacturing, and early deployment of the technologies. The DOE also wants to bring together consortia to work together on fuel cell cost, performance, and durability, as well as hydrogen storage research. "As FCEVs become increasingly commercially available, the Energy Department is focused on advancements to enable hydrogen infrastructure including production, delivery, storage, and manufacturing, as well as continuing to reduce fuel cell cost and improve durability," the DOE said in a statement. Read more from the DOE. A Volkswagen e-Up! caught fire after a collision with a train in Norway. The driver, Christopher Traasdahl Saether, was able to jump from the electric Volkswagen before the train hit, and was physically unharmed. It also appears that there were no injuries among the passengers on the train. "It was quite a way to start the day," says Saether. A photographer at the scene reported that the car burst into flames when a salvage crew attempted to remove the wreckage from the railway crossing. Are more diesel scandals about to erupt?

More automakers may soon be embroiled, like Volkswagen, in diesel emissions scandals. According to the Daily Kanban, either the International Council on Clean Transportation (ICCT) or the Deutsche Umwelthilfe (DUH) will soon announce from 10 to 15 more cases of automakers cheating national diesel emissions rules. The outlet says three of the incidents are attributed to Opel. Studies conducted by the DUH, the University of Applied Sciences in Bern, Switzerland, and the UK's Leeds University found that Opel's diesel Zafira, Corsa, and Vectra models emit more NOx than European regulations allow when tested in ways that go beyond the European testing protocol, such as when done on a four-wheel rolling road instead of a two-wheel rolling road. Opel said the accusations had no merit. Specifically on the Zafira, the DUH asked Opel about the emissions findings, and Opel said that no General Motors software contains any measures to enable cheating. Opel then tested a Zafira of its own "both on a two- and a four-wheel roller dynamometer," finding that "The emission behavior determined in each case does not differ from one another." That makes this a case of he-said-she-said for the moment. The Daily Kanban's sources say the cheating methods "range from the crude to the highly sophisticated," with those at the latter end complex enough to render Volkswagen's methods "pedestrian." As for any automakers who might be named, the matter of real-world emissions exceeding a legal limit doesn't mean a carmaker has designed systems that cheat, it might mean the company designed the car to pass a test.
