Winterkorn not under official investigation in Germany

Prosecutors for the state of Lower Saxony in Braunschweig, Germany, are now saying that former Volkswagen CEO Martin Winterkorn is no longer specifically under investigation for his role in alleged fraud related to the automaker's diesel emissions scandal. The lawyers are clarifying that there's no formal inquiry into the exec because there's not yet enough evidence to establish a suspicion of wrongdoing, Bloomberg reports. However, they are still looking into VW's actions. Earlier this week, the prosecutors announced they had begun an initial investigation into Winterkorn for alleged fraud in the emissions regulation evasion. At that time, there were reportedly 12 complaints asking the lawyers to look into the case, including one from VW. Under German law, only a person could be charged for the potential crimes, rather than a whole company. "An initial suspicion must be based on facts, and you must begin an investigation before you can establish the facts," Christoph Schalast, a professor at the Frankfurt School of Finance, said to Bloomberg. Meanwhile in the US, the investigation continues into VW. The Department of Justice has the support from at least two senators to pursue criminal and civil charges against the company. The attorneys general in at least 29 states are also looking into things. Meanwhile, lawyers are building a class-action lawsuit, as well. To help in its defense, the automaker is employing the help of the same firm that defended BP during the Deepwater Horizon oil spill. Related Video:

Giorgetto Giugiaro launching new design firm

Giorgetto Giugiaro may have sold his remaining shares in the Italdesign firm he started, but he's not about to retire from the business altogether. According to an interview with Automotive News Europe, he's starting a new design consultancy. And he's taking his son, Fabrizio, with him. After working for established design houses Bertone and Ghia, the celebrated designer founded Italdesign Giugiaro in 1968. In 2010 he and his son Fabrizio sold 90.1 percent of the firm to the Volkswagen Group, with Fabrizio initially carrying on as its chief designer before Wolfgang Egger replaced him. Just months ago, the Giugiaros sold their remaining stake and resigned their seats on the board of Italdesign. The move came hot on the heels of the departure of ousted board chairman Ferdinand Piech, a longtime friend of Giorgetto's and the driving force behind VW's acquisition of Italdesign. Just because they're no longer affiliated with Italdesign Giugiaro doesn't mean, however, that the Giugiaros won't be designing cars anymore. They're reportedly working on establishing a new design house, and are discussing potential contracts with unnamed Chinese and South Korean automakers. The father-son pair could set up shop in a refurbished existing location (as the pragmatic Fabrizio favors) or build a new studio from the ground up (as the visionary father prefers). We'll have to hold on to see what direction the new firm takes, but most of all, we'll be looking forward to seeing what designs it produces. South Korea to file criminal charges against VW exec

South Korea has tossed out Volkswagen's recall plans and is preparing to level criminal charges over its handling of the diesel emissions catastrophe, The Wall Street Journal reports. "Recall plans the company submitted to us earlier this month were insufficient and lacked key information, and thus are unacceptable," the South Korean Ministry of Environment said in a statement obtained by the WSJ. A ministry official hinted at the possibility of criminal charges earlier this month if VW's recall plan wasn't satisfactory, the Yonhap News Agency reports, and now it looks like it will actually follow through. According to the WSJ, South Korea has already ordered VW to recall 125,000 vehicles and slapped the automaker with a $12.3 million fine – one of the many countries to do so – but if it follows through with criminal charges against the company or its employees, it'd be among the earliest to so. Other countries, including the United States, are still exploring the possibility of criminal charges. Charges would likely come against both Audi Volkswagen Korea and its managing director, Johannes Thammer. It's not clear what the actual charge would be, but the WSJ claims Thammer could be facing up to five years in prison and a fine of 30 million won (around $24,700 at today's rates). For its part, VW officials in South Korea maintains that it is "doing its utmost to resolve the emissions issue" and that it plans to "offer further explanation" to authorities regarding its proposal for an emissions and fuel mileage fix in that country.
