Senators want civil, criminal actions against VW

With the Department of Justice just beginning its investigation into Volkswagen's emissions evading diesels, Senators Richard Blumenthal and Amy Klobuchar are pushing for the automaker to be prosecuted to the fullest extent of the law both civilly and criminally. In a letter to Attorney General Loretta Lynch, they press the agency to make its scrutiny "thorough but expeditious." The politicians allege that VW misled people while pumping huge amounts of pollution into the air. The Senators believe that all the information about VW's actions needs to make it to the public eye, and the DOJ must have a strong response to the automaker breaking the law. "Officials at Volkswagen should be granted no get out of jail free card, and the Department should accept no plea agreement with Volkswagen that does not ensure any and all information regarding criminal acts by high level officials is provided to the Department," they write. Senator Blumenthal is no stranger for championing changes in the auto industry as of late. He was an advocate for the General Motors Ignition Switch Compensation Fund and pushed for a similar organization for Takata airbag victims. VW's credit ratings could take a beating

In addition to a significant drop in its share price already, Volkswagen's diesel emissions scandal is continuing to have major financial repercussions on the German automaker. According to The Detroit News, credit rating agencies like Standard & Poor's and Moody's changed their forecasts on the company to negative, and Fitch has considered doing so, as well. Volkswagen appears to have the money to cover the costs of this ordeal, but the agencies question the effect that this has in the long term. "Moody's concern, however, is that Volkswagen's alleged breach of US environment rules and, especially, the process by which that breach occurred, will have an adverse effect on its reputation and credibility within the global passenger car markets," the company wrote in a note to investors, according to The Detroit News. VW has initially set aside $7.25 billion to fix things, but the potential shakeup of top executives has caused some investor uncertainty, too. The actual costs for VW to deal with this scandal are still unknown. In the US, the Department of Justice has begun a criminal investigation, and with other automakers the government has settled for $900 million against General Motors and $1.2 billion against Toyota. Attorneys general in 29 states have started looking deeper, according to The Detroit News, and regulators in Europe, South Korea, and Canada have commenced their own probes, as well. Related Video:

Volkswagen is working on a fix for diesel-engined vehicles that are out of compliance with emissions regulations in the US and other countries. We're told that engineers will be presenting a solution internally sometime this month, but that doesn't mean we'll actually see it in the wild this month. One big question we have about the coming fix is, will it affect the car's performance? That question relates to another we have about the engine as it is: How much performance would the 2.0-liter diesel lose right now if it were turned down to pass US emissions? The Fast Lane Car tried to sketch some answers by going to a shop in Denver, Colorado to run a 2011 Jetta TDI with a six-speed DSG transmission on an all-wheel-drive dyno. The thinking was that if you ran all four wheels the car would think it was on the road, whereas if you ran only two the car might think it's being tested. We'll get straight to the numbers: the stock sedan is quoted at 140 horsepower and 236 pound-feet of torque. When run with all four wheels turning it produced an uncorrected 114 hp and 214 lb-ft at the wheels. When run with just two wheels in motion the Jetta got 113 hp and 188 lb-ft at the wheels. Reading the graph, we're told that power differences between the two runs were as much as 15 hp and 32 lb-ft. You'll need to take some salt with these numbers, though, because the dyno and test protocol in the video are nothing like those used by the EPA. The shop attempts to trick the Jetta into 'emissions testing mode' by using the front wheels only for the two-wheel-drive run, but we have a feeling the software code at issue is far more sophisticated than that, since the ICCT, UVA, the EPA, and CARB investigated the situation for more than a year and couldn't figure out. Also, the technician adjusts for being a mile above sea level with a correction factor of 1.2 applied to horsepower and torque, which inflates the disparity in the final power differences over the two runs.
