Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Japan wants to boost fuel-cell numbers 100x by 2020

How many hydrogen refueling stations will Japan need? Can each station handle 250 fuel-cell vehicles? They can in the Japanese government's new plans for hydrogen fuel-cell vehicle growth and station deployment throughout the country. With Prime Minister Shinzo Abe continuing to trumpet fuel cells as the advanced powertrain of the future, the government says the number of fuel-cell vehicle on its roads will multiply by 100 within the next four years, according to the Japan Times. Specifically, Japan, which is home to about 400 fuel-cell vehicles today, hopes to have 40,000 by 2020 and a whopping 800,000 by 2030. More importantly, Japan has 80 stations either in operation or slated to be deployed soon, and hopes to double that number by the end of the decade. For perspective's sake, the US has about two-dozen publicly accessible hydrogen fuel cell stations today, according to US Department of Energy. The newer ones are can dispense 100 kilogram a day, which can fuel 20-25 cars a day. Japanese automakers Honda and Toyota appear to be trying to do their parts in the H2 plan. Earlier this month, Honda started leasing its Clarity fuel-cell vehicle in Japan and is planning to bring them to California later in the year. The vehicle, which is priced at about $68,000 in Japan, is said to be able to travel about 466 miles on a full hydrogen tank, per the more lenient Japanese driving cycle (roughly 300 miles on the US scale). Honda will start production at a rate of 200 vehicles a year. With skin in the game, though, Honda indicated late last year that it was frustrated with what it said was the slow pace of fuel-cell station deployment in Japan, according to Bloomberg News. Honda was collaborating with hydrogen supply company Iwatani Corp. on what they called a "Smart Hydrogen Station," though that concept was in its testing phase as of last December. The Mirai also started sales in Japan and debuted in limited numbers in California last year. Last fall, Toyota set a rather lofty goal of selling 30,000 fuel-cell vehicles a year by 2020 as part of its Toyota Environmental Challenge 2050. Toyota promises a next-generation Land Cruiser is on its way

On sale since the 2008 model year and facelifted twice in the interim, the Toyota Land Cruiser has lately begun rolling out the special editions. Last year we got the 2019 Lexus LX Inspiration, this year we got the 2020 Land Cruiser Heritage Edition. This likely means a changing of the model guard is close, the 300-Series Land Cruiser on the horizon to replace the current 200-Series. When Motor Authority asked Toyota SVP Bill Fay about the U.S. getting the next generation, Fay replied, "We are fully committed to the Land Cruiser for the foreseeable future." The reason for the question could have been Land Cruiser sales figures for the past 14 years, when the model never cleared 5,000 units. The swankier Lexus LX sibling sells in greater numbers, but even lumping the two trucks, they've crested 10,000 sales just twice since 2005. On top of that, two of the largest regional markets for the Land Cruiser are Australia and the Middle East, which have different regulatory regimes, and the 2019 Highlander has a three-row option. Why carry on with the Land Cruiser here? Fay told MA the body-on-frame bruiser is a "heritage vehicle," a staple in the U.S. lineup since 1958. But the Cruiser that comes next is expected to LS-ify its powertrain formula, which means getting rid of V8s for V6s. The 5.7-liter V8 with 381 horsepower, 401 pound-feet of torque, and an EPA rating of 15 miles per gallon combined should go away. The 3.5-liter twin-turbo V6 in the Lexus LS 500 gets the nod to take its place, as the Land Cruiser make concessions to fuel economy and emissions standards. A poster on a forum said it's possible that a Dynamic Force version of that engine might appear. As is, that engine makes 416 hp and 442 lb-ft in the luxury sedan and is mated to a 10-speed automatic, the same transmission said to replace the current eight-speed in the Land Cruiser. Automotive mediums predict a hybrid Cruiser, too, potentially with the same 3.5-liter naturally aspirated V6 and 10-speed auto in the LS hybrid, putting out 354 combined horsepower in the sedan. Because there are so many Land Cruiser versions around the world, it's impossible to say whether V8 options will die globally. Land Cruiser fans, either through desperation or good intel, say that isn't the case.
