Toyota settles for $3M after being found liable in sudden acceleration case

A jury has decided that faulty software was to blame for a crash involving a 2005 Toyota Camry that killed one woman and injured another. This is the first time Toyota has been found liable by a jury in a lawsuit involving sudden acceleration claims. Toyota has maintained that driver error is the most likely cause for cases of sudden acceleration.
Shortly after the jury in the case, which took place in Oklahoma and centered around a crash that injured 76-year-old Jean Bookout and killed her passenger, Barbara Schwarz, reached a verdict that would see Toyota paying $3 million in compensatory damages, a confidential settlement was reached. The jury, which had found Toyota liable for "reckless disregard" for public safety, had yet to decide what punitive damages Toyota would face.
Toyota said in a statement, "While we strongly disagree with the verdict, we are satisfied that the parties reached a mutually acceptable agreement to settle this case. We will continue to defend our products vigorously at trial in other legal venues."

The makers of Racing Extinction used a tricked out Tesla Model S for their movie. The artists and activists used the electric car as a platform to project images from nature in various cities to raise awareness about imperiled wildlife. In addition to a the high-powered projector, the Model S features a electroluminescent paint job that emits light to mimic creatures found in the wild, such as bioluminescent sea life. WardsAuto has named the 2016 Hyundai Sonata Plug-In Hybrid's powertrain to its list of 10 Best Engines. As the first plug-in hybrid to make the list, WardsAuto World Editor-in-Chief Drew Winter praises Hyundai engineers for their "impeccable job blending fuel efficiency with refinement and daily usability." Wards notes the car's smooth transitions between electric and hybrid modes, and a well-connected six-speed automatic transmission. FEV's plug-in hybrid battery pack has gone into vehicle series production. The 10-kWh battery pack, developed by the German development services provider, offers an all-electric range of about 30 miles. FEV says its battery management algorithms are just as important as choosing the right battery hardware. "The core system for the battery development is our own mature battery management system (BMS), now in its third generation, that together with optimized algorithms allows a very reliable and stable control of the battery," says FEV's Dr. Michael Stapelbroek. Kayaba, Sumitomo to pay millions for price-fixing in US

Kayaba Industry Co, which does business in the US as suspension parts maker KYB, and Sumitomo Electric Industries are facing payments in the millions to settle price-fixing cases about the components that they make. As part of the Department of Justice's ongoing crackdown of price fixing in the auto industry, KYB agreed to pay $62 million and pleaded guilty to conspiracy to set the cost of shock absorbers from the mid '90s through 2012. The company allegedly worked with co-conspirators to keep the cost of the parts high, and those components then made it into vehicles from Honda, Kawasaki, Nissan, Subaru, Suzuki, and Toyota. "Any collusive agreement among competitors to restrict price competition undercuts our free enterprise system and violates the law," said Carter M. Stewart, US Attorney of the Southern District of Ohio, in the DoJ's announcement. Over the past few years, the DoJ has brought cases against 37 parts suppliers and 55 executives, leading to over $2.6 billion in fines. The investigations haven't always been so successful – some of the Japanese execs fled from the US to avoid prosecution. Critics allege that price fixing is simply how business is done. According to Automotive News, Sumitomo Electric Industries is also facing a $50 million settlement in a civil lawsuit that's related to price fixing of parts like wiring harnesses and heater control panels. The plaintiffs include owners and dealers that purchased vehicles with these parts. The company asserts that the violations are from before 2010, and it now has different process in place to avoid further violations. KYB Agrees to Plead Guilty and Pay $62 Million Criminal Fine for Fixing Price of Shock Absorbers Kayaba Industry Co. Ltd., dba KYB Corporation (KYB) has agreed to plead guilty and to pay a $62 million criminal fine for its role in a conspiracy to fix the price of shock absorbers installed in cars and motorcycles sold to U.S. consumers. According to charges filed today, KYB conspired from the mid-1990s until 2012 to fix the prices of shock absorbers sold to Fuji Heavy Industries Ltd. (manufacturer of Subaru vehicles), Honda Motor Co. Ltd., Kawasaki Heavy Industries Ltd., Nissan Motor Company Ltd., Suzuki Motor Corporation and Toyota Motor Company, including their subsidiaries in the United States.
