Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

The European Union is funding Fastned EV fast-charging corridors in Germany. The EU has set aside 2 million euros as part of its Trans-European Transport Networks program for Fastned to build the charging stations along major highways in Germany. The EU plans to help fund a network of 155 fast-charging stations along popular routes in Germany, Sweden, Denmark and Holland. Of those, Fastned will build 94 stations in Germany and Holland. Read more in the press release below. Revised hydrogen rules in Japan will make it easier to create hydrogen fueling infrastructure. Japan's Ministry of Economy, Trade and Industry has created guidelines allowing for liquefied hydrogen at filling stations, exceptions to required distances between precooling equipment and public facilities and less expensive materials for hydrogen storage. Toyota stands to gain from the new standards, as making fueling more readily available makes it easier to sell customers on the Mirai fuel cell vehicle. The result could be fiercer competition between Toyota and Tesla in Japan. Read more in the press release below, and at Tech In Asia. New research finds that New Delhi roads suffer from much worse pollution than the average levels recorded throughout the city. Pollution along roads is up to eight times higher than the numbers shown by urban background pollution monitors. With half of the city's population living within 300 meters of a major road, it's a major health concern. Joshua Apte of the University of Texas, Austin, recorded various pollution levels from inside vehicles in hopes of showing the difference between ground-level pollution and the lower numbers at monitoring sites. Cosworth announces Power Packages for Subaru BRZ, Scion FR-S with up to 380 hp [w/video]

Cosworth stands on the list of the most famous engine tuners in the world with its DFV engine engine dominating Formula One for a time in the '70s. So when it teases plans to take on the FA20 engine from Subaru and Toyota found in the BRZ, Scion FR-S and Toyota GT86 abroad, our interest is indeed piqued. Cosworth is promising to take the 2.0-liter, four-cylinder boxer engine from its current 200 horsepower all the way to 325 hp and even 380 hp in a future track version through a series of staged Power Packages. At the moment, only the first stage is available that takes the mill to a potent 230 hp.
Cosworth says that its new strategy is to offer its upgrades in kits rather than individually so that it can be sure that everything works and fits when owners receive it. The Stage 1 Power Package emphasizes helping the FA20 breathe better and includes a nearly complete replacement for the stock exhaust system. There is a sports exhaust with four-inch, diagonally cut, polished tips and Y-shaped muffler, an overpipe front pipe with a spherical resonator and a new manifold header that is 22 percent lighter the standard unit. In addition to that, the kit comes with a software reflash, low temperature thermostat, Cosworth badge and plaque.
The stage one kit is available now, and stages two and three go on sale later this summer, according to its website. Autoblog contacted Cosworth for pricing information for the kits.
