Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Toyota recalling small number of 2014 FJ Cruisers for possible steering failure

Toyota is issuing a fairly tiny recall to fix a potentially serious problem in the FJ Cruiser. The company is recalling about 120 examples of the rugged SUV from the 2014 model year because the steering can fail. According to Toyota, the intermediate shaft that connects the steering wheel and steering gear box might not be welded correctly and can separate. If this happens, drivers lose steering control, which is obviously a major safety concern. However, the automaker is not aware of any crashes, injuries or fatalities from the problem. On the small number of affected models, Toyota will replace the intermediate shaft with a new one. TOYOTA RECALLS CERTAIN 2014 MODEL YEAR FJ CRUISER VEHICLES TORRANCE, Calif., February 5, 2015 – Toyota Motor Sales, U.S.A., Inc., today announced it will conduct a safety recall of approximately 120 Model Year 2014 FJ Cruiser vehicles. The steering system contains an intermediate shaft, which connects the steering wheel to the steering gear box. In the involved vehicles the intermediate shaft could have received an inadequate weld. Under some circumstances, the weld could separate, resulting in the loss of steering control and increasing the risk of a crash. Toyota is not aware of any crashes, injuries, or fatalities caused by this condition. Owners of the involved vehicles will receive a notification by first class mail. MotorWeek remembers retro icons, Supra and NSX

It's easy to poke a joke here and there about John Davis, the long-time host of MotorWeek. His voice is so monotonous that, from time to time, if you closed your eyes, you may think it's generated via a computer. But you have to give him and the rest of the show a lot of credit. The program has been on the air for decades, giving people direct, straight-down-the middle automotive reviews.
MotorWeek's massive back catalog of reviews are slowly making their way onto YouTube, and they provide a fascinating chance to look back on how performance cars rank against their contemporaries from back in the day. Two recent additions include the show's old looks at the 1986 Toyota Supra, the dawn of the third-generation model, and the now-iconic 1991 Acura NSX.
Both reviews are interesting in their own way. These days you hear nary a negative word about the original NSX, but MotorWeek isn't afraid to point out a few flaws.
