Toyota follows Tesla, makes hydrogen patents open source

Back in June, Tesla said All Our Patents Are Belong to You as it released its electric vehicle patents to the world. CEO Elon Musk said at the time that patents, "serve merely to stifle progress, entrench the positions of giant corporations and enrich those in the legal profession." Despite some disagreement on which gasoline alternative (electricity or hydrogen) will power the automotive future, it looks like the folks over at Toyota like the idea of making advanced technology easier for others to get their hands on. Last summer, Tesla said that it would, "not initiate patent lawsuits against anyone who, in good faith, wants to use our technology." In an announcement today at CES, Toyota said it would let "automakers who will produce and sell fuel cell vehicles, as well as ... fuel cell parts suppliers and energy companies who establish and operate fueling stations" get free access to 5,680 fuel cell related patents around the world. That means if you're interested in building your own Mirai H2 car, you can now get some of the instructions. There's a catch, though, in that Toyota's H2 vehicle patents will only be free, "through the initial market introduction period, anticipated to last until 2020." Patents about making and selling hydrogen will be free "for an unlimited duration." Toyota's Senior VP of Automotive Operations, Bob Carter, said that, "At Toyota, we believe that when good ideas are shared, great things can happen. ... By eliminating traditional corporate boundaries, we can speed the development of new technologies and move into the future of mobility more quickly, effectively and economically." Toyota generates a lot of patents each year – 1,491 in 2012 in the US alone, for example – but it did not see fit to make them all open to competitors. While we don't know for sure how many automakers have decided to use Tesla's patents since they were made public, but it appears that interest in the technology is muted. We'll have to wait and see how the industry reacts to the influx of H2 information. We hope this will be one of the topics Musk addresses in his Reddit AMA later today. Toyota nearing $1B settlement of unintended acceleration criminal probe

According to those all-too-nebulous "people familiar with the matter," Toyota is close to a settlement with the US federal government to end a criminal probe over its long-running unintended acceleration fiasco. Though Toyota has never admitted guilt, the deal could reportedly crest a billion dollars and would likely include a criminal deferred prosecution agreement, and while we're not legal experts, The Wall Street Journal explains that such a deal would "[force Toyota] to accept responsibility while avoiding the potentially crippling consequences of federal criminal convictions."
The report from WSJ also suggests that Toyota is facing charges that it "made false or incomplete disclosures" to various government agencies regarding possible defects to its cars. Such charges may include mail and wire fraud violations. Toyota has already paid out fines totaling $66.2 million to the National Highway Traffic Safety Administration because it failed to report safety defects in a timely manner.
This deal with the federal government is not related to the billion-dollar class-action settlement reached with Toyota owners over falling vehicle values, and it's also different from the roughly 400 lawsuits still in courts alleging personal injury of wrongful death due to cases of unintended acceleration. In other words, don't expect to hear the end of such courtroom verdicts and settlements anytime soon...

2013 Pikes Peak Hill Climb, Practice Day 3

The third practice day of the 91st Pikes Peak International Hill Climb is done. While the other classes got running time on the middle and top sections of the course, qualifying times were set on the bottom section of the course for the Open, Open Wheel, Electric, Exhibition and Vintage classes.
Everyone managed to keep it on the black stuff today, Greg Tracy setting the fastest time ahead of Hiroshi Masuoka, both men driving the Mitsubishi MiEV Evolution II four-wheel-drive prototype. Not even half a second behind Masuoka came Nobuhiro "Monster" Tajima in his Monster Sport E-Runner, who has taken about 18 seconds off his time since the first practice day. Rod Millen was the fourth fastest on the day in his Toyota TMG EV POO2.
Topping the Open Wheel class was Clint Vahsholtz, followed by Donner Billingsley, Andy Figueroa and Rodney O'Maley. The only driver in that class not to be given a time today was Dan Novembre. Kenshiro Gushi took the Exhibition class today as his Lexus IS F CCS-R made it up the mountain in 4:27.248, followed by Sage Marie in the Honda CR-Z at 5:19.591. Simon Pagenaud and his Honda Odyssey weren't classified.
