Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Keep in mind that you will need a full set of four snow tires for safety and performance, no matter what you're driving. The days of your dad putting just two snows on the family truckster to get it moving in a straight line are long gone. Don't get us wrong, getting a car that performs well in snow and ice is still a worthy criteria for car buyers. According to the U.S. Transportation Department, 70% of Americans live in places that get snow and ice. And much of the country has been blasted with arctic air for much of the new year. So let's look at the cars. First, we're highlighting choices for a variety of buyers and price points. Second, we're not just considering snow; we're considering general wintery conditions people will experience driving to work or school. As such, these are all choices with advanced all-wheel-drive systems, usually with "torque-vectoring" systems that not only automatically shunt power front and back, but side to side between the rear axles. Toyota takes aim at Musk's criticism of hydrogen 'fool cells'

Tesla's Elon Musk has called hydrogen fuel cell cars "a load of rubbish" and "fool cells," and he's nowhere near alone in his disdain for the technology. Toyota has been fighting back waves of condescension for years now, and did so again when Senior VP Bob Carter took the stage at the recent J.D. Power Automotive Summit this month. His target was comments that Musk made at the Automotive News World Congress at the Detroit Auto Show, when Musk said an FCEV was an "extremely silly way" to store energy, that "the best-case hydrogen fuel cell doesn't win against the current-case battery" and that hydrogen's failings will become obvious in the next few years. Carter's response was that the fuel cell initiative isn't about the next few years. "This is not a 24-to-36-month play, but when you start looking into the 2020s," then you can see the necessity of hydrogen fuel cells, which Toyota considers an extension of EV technology, he said. The Toyota Mirai will begin its defense of the FCEV industry in the US later this year. The Hyundai Tucson Fuel Cell is already available in California and Honda's hydrogen car will arrive in 2016. Until then, we can let some more of Carter's words ring in our ears: "If I was in a position where I had all my eggs in one basket," he said of Musk's BEV-only focus, "I would perhaps be making those same comments."
