Tesla strikes back against Lemon Law King over Model S dispute [UPDATE]

*UPDATE: We have now also received a statement from the Model S owner in question, which has been added below. When we asked Tesla Motors for a statement on the lawsuit filed by the "King of Lemon Laws" the other day, the company told us that it does not comment on pending litigation. Fair enough. That's a standard response. But the company has since felt the need to comment on the issue using its own company blog. In a post called "When Life Gives You Lemons...," the Tesla Motors Team called lawyer Vince Megna (indirectly) an "opportunistic lawyer" and basically called him a liar. To wit: "... there are factual inaccuracies in the lawyer's story." Tesla says that the three claimed incidents when the Model S owner in question asked the automaker to buy the car back did not happen (Tesla acknowledges it happening once). And then the company basically says the owner was breaking his car on purpose: ... the car's fuse blew on three occasions. Each time, our engineers explored all possible explanations and were never able to find anything wrong with the car. Still, just to be sure, we replaced several parts that could have been related to the alleged problem – all at no expense to the customer. When the fuse kept blowing despite the new parts, and faced with no diagnosis showing anything wrong with the car, the engineers were moved to consider the possibility that the fuse had been tampered with. After investigating, they determined that the car's front trunk had been opened immediately before the fuse failure on each of the three occasions. (The fuse is accessed through the front trunk.) Ultimately, Tesla service applied non-tamper tape to the fuse switch. From that point on, the fuse performed flawlessly. Ohio senator with deep dealer ties proposes anti-Tesla bill

The fight against customer-direct car sales by Tesla Motors continues around the US, and the California-based company can now count dealership groups in Georgia and Ohio among its adversaries. In Ohio, Tesla has opened company-owned stores in Cincinnati and Columbus and is now fighting a state dealership association that's pushing for legislation that explicitly outlaws direct dealer-to-public sales after a lawsuit against Tesla was dismissed last week, Automotive News says. The proposed law (Senate Bill 260) would prevent any entity from selling vehicles if it "is a manufacturer, or a parent company, subsidiary, or affiliated entity of a manufacturer, applying for a license to sell or lease new or used motor vehicles at retail." Under Ohio's current laws, Tesla says its stores are perfectly legal, but clearly that would would drastically change if SB260 becomes law without some sort of provision to 'grandfather' dealers opened before the legislation passes. Ohio's dealers say Tesla threatens their network since it sets a precedent for other automakers to use the same practice. The politician behind the bill received at least $42,825 from dealership owners, employees and PACs. The politician behind the anti-Tesla bill in Ohio is Senator Tom Patton (R-Strongsville), who "received at least $42,825 from state and national auto dealership owners, employees, and political action committees (PACs) between 2002 and 2013," according to Media Trackers. His Facebook page is filling up with negative comments about his "crony capitalism" actions. Meanwhile, a Georgia exemption from that state's prohibition of automaker-to-public sales states that a company can directly sell as many as 150 zero-emissions vehicles a year, the Atlanta Business Chronicle says. Tesla sold about 500 of its Model S sedans there last year, with the rest of the cars being registered in California. The automaker is looking to expand that exemption tenfold to 1,500 vehicles. Georgia and Ohio join states such as Massachusetts, New York and Texas that have done battle with Tesla and its business model, with Texas thus far being the most formidable opponent. CEO Elon Musk said last year that he may go to the federal government to get such laws changed on a national level. That's not surprising since Tesla's preparing to start selling its Model X crossover and could unveil its cheaper EV (possibly called Model E) at the Detroit Auto Show next year.

Recharge Wrap-up: Mazda, Subaru and Toyota PHEV, Nomadic Power grant

The next generation of the Toyota Prius Plug-in Hybrid looks to be important for Mazda and Subaru as well. Toyota will likely need to sell more of the new plug-in hybrid to meet stricter ZEV standards in California. That means it will get more extra electric range, as customers have been asking for. Subaru and Mazda will also have to adhere to the California standards beginning in 2018. Those two smaller automakers will likely license a plug-in hybrid powertrain from Toyota in order to fulfill compliance. Read more at Green Car Reports. Tesla is partnering with Dalhousie University to improve battery technology. Tesla signed a five-year research agreement with Dalhousie's Jeff Dahn, a lithium-ion battery researcher. Dahn and the 25 researchers in his lab will work with Tesla's Director of Battery Technology, Kurt Kelty, to increase capacity through improved materials. The collaboration could be important both for Tesla's automotive and stationary batteries. "Our research group's goal is to increase the energy density and lifetime of Li-ion batteries, so we can drive down costs in automotive and grid energy storage applications," says Dahn. Read more from Dalhousie University. Nomadic Power is receiving a European Commission grant worth ˆ2 million (about $2.26 million) for trailer-mounted mobile batteries. Nomadic Power's mobile batteries, called Nomads, have incorporated photovoltaic systems and can be used to extend the electric driving range of a plug-in vehicle, or to provide backup power to a home. The Nomads use an intelligent energy management system to learn and predict user behavior and manage the solar system based on weather forecasts. "We see a strong future in electric-powered mobility and an increasing use of renewable energy, photovoltaic power in particular," says Nomadic Power CEO Dr. Manfred Baumgaertner.
