Tesla strikes back against Lemon Law King over Model S dispute [UPDATE]
Thu, Apr 10 2014*UPDATE: We have now also received a statement from the Model S owner in question, which has been added below. When we asked Tesla Motors for a statement on the lawsuit filed by the "King of Lemon Laws" the other day, the company told us that it does not comment on pending litigation. Fair enough. That's a standard response. But the company has since felt the need to comment on the issue using its own company blog. In a post called "When Life Gives You Lemons...," the Tesla Motors Team called lawyer Vince Megna (indirectly) an "opportunistic lawyer" and basically called him a liar. To wit: "... there are factual inaccuracies in the lawyer's story." Tesla says that the three claimed incidents when the Model S owner in question asked the automaker to buy the car back did not happen (Tesla acknowledges it happening once). And then the company basically says the owner was breaking his car on purpose: ... the car's fuse blew on three occasions. Each time, our engineers explored all possible explanations and were never able to find anything wrong with the car. Still, just to be sure, we replaced several parts that could have been related to the alleged problem – all at no expense to the customer. When the fuse kept blowing despite the new parts, and faced with no diagnosis showing anything wrong with the car, the engineers were moved to consider the possibility that the fuse had been tampered with. After investigating, they determined that the car's front trunk had been opened immediately before the fuse failure on each of the three occasions. (The fuse is accessed through the front trunk.) Ultimately, Tesla service applied non-tamper tape to the fuse switch. From that point on, the fuse performed flawlessly. The key line: "There are companies, great companies run by Billionaires, that force consumers to give up their Freedom of Speech and Right to Trial by Jury just for the opportunity to buy an electric car." Will Bob Lutz's VL Automotive really offer V8 conversions for Tesla Model S?

The company's first product, the Destino, is a converted Karma and the Destino Red Concept, just unveiled at the Detroit Auto Show, is the same hardtop Karma convertible that Fisker showed in 2009. So, what a surprise it was to see that Bob Lutz, who owns half of VL Automotive, is ready to convert a brand new electric vehicle: the Tesla Model S. A gas-powered Tesla? Say what? A gas-powered Tesla? Say what? That's at least one way to read this short article in The Detroit News. There's not a lot of context and a distinct lack of details, so we're left wondering if maybe Lutz just meant that Model S owners can buy a Destino. You can read the exchange for yourself here. What we do know is that Lutz said that VL Automotive has already sold nine Destino conversions. The cars cost $200,000, up from the previous estimate of $180,000, and well above the $116,000 max price tag on the original Karma. For your money, you get a 6.2-liter V8 taken from a Chevrolet Corvette that puts out 636 horsepower and can beat the 135-mile-per-hour top speed that the Karma has. Lutz said that all could add up to sales of around 200 or 300 Destinos each year. EPA says automakers ahead of schedule for 54.5 MPG by 2025
Sat, Apr 26 2014Remember, the target is 54.5 miles per gallon by 2025. Today, the CAFE level is a little over 30. How we get from here to there is something the US Environmental Protection Agency (EPA) is monitoring closely. Thus, the EPA just released an annual flash report on how the auto industry is progressing towards meeting the nation's fuel economy goals. Overall, the industry is doing almost 10 grams per mile (equivalent) better than the rules require. The good news is that the industry is a bit ahead of schedule. In the report (see page iii), the EPA breaks things down by automaker based only on MY12 numbers. Tesla is at the top of the list (which is ranked by over-compliance with 2012MY CO2 standards), but for our money, the real leader is Toyota. The Japanese automaker built the second-highest number of vehicles (2,020,248, after General Motors' 2,364,374) but racked up the most net 2012 over-compliance credits (13,163,009 metric tons). That's an average of over 6.5 metric tons per vehicle. The next closest is Honda, with just over five metric tons of credits per vehicle. Given the MPG fiasco with Hyundai and Kia, the EPA says, "we are excluding Hyundai and Kia data because of the ongoing investigation into their testing methods," but overall, the rest of the industry has credits worth 25,053,168 metric tons of CO2, which means it's doing almost 10 grams per mile (equivalent) better than the rules require. Go team. For now, the numbers in this report (and there are a lot more of them – get the 59-page PDF for yourself here), can't really be used to understand everything from the first year of the new CAFE program. The EPA writes, "Because the program allows credits and deficits to be carried into future years, at the close of the 2012 model year no manufacturer is considered to be out of compliance with the program. ... Compliance with the 2012 model year standards can't be fully assessed until the end of the 2015 model year." There are a more interesting tidbits in the report, such as the fact that Fisker produced 1,415 model year 2012 vehicles, Tesla made 2,952. Remember, too, that CAFE numbers don't equal the fuel economy you see in your daily drives. In the real world, the 54.5 CAFE level will be about 40 mpg, and the average fuel economy today is around 25 mpg, so we have a ways to go, no matter how you measure it.
