Subaru suing CA dealership for alleged false customer surveys

Whenever you buy a new car from a dealer these days or sometimes even go in for service, you can expect to fill out a customer satisfaction survey at some point down the road. The responses are actually quite important to showrooms because automakers require the businesses to keep things at a certain level or face penalties. However, a Subaru dealer allegedly found a way to game that system, at least briefly, and now the Subaru of America has filed a lawsuit in US District Court for breach of contract. South Coast Subaru in Costa Mesa, CA, reportedly falsified 224 customer satisfaction questionnaires in 2014, according to Automotive News. The scheme wasn't that hard to figure out, though. All of the faked surveys were allegedly submitted through the IP address of an Acura showroom managed by the same dealer. Under normal circumstances when someone buys a Subaru, the dealer is supposed to collect the customer's email address and submit it to the automaker. However, South Coast allegedly presented false addresses, and then managers had employees fill the forms out during lunch. Subaru claimed in the suit that by doing this the dealer harmed the company's product reputation and its goodwill among customers. "Defendants prevented Subaru from discovering the actual customer satisfaction level of Subaru retail customers at South Coast Subaru by providing sham customer surveys to [Subaru]," the complaint said, according to Automotive News. As expected, Subaru had a bunch of cameras rolling when they gunned for a Nurburgring lap record attempt. The car they used was a specially honed (deep breath) WRX STI Type RA NBR Special, and it proved to be good for a 6:58.9 lap around the Nordschleife, in the hands of Richie Stanaway. Now, video material of the sedan car record run has been posted on Subaru's social media pages, and it includes a separate "Behind the Scenes" video. The record car was built by Prodrive, and it consists of a 2017 WRX STI with a full roll cage, fitted with a WRC specification two-liter turbo engine that produces more than 600 horsepower thanks to its 75mm intake and 25 psi of boost. The transmission is also a WRC item, and its hydraulic paddle-shift setup together with an automated clutch enables shift times of 20-25 milliseconds. The track time is quicker than a recent privateer attempt using a 2017 Dodge Viper ACR, which squeezed the time down to 7:01,3 until a tire failure caused it to crash. Subaru recalls new Forester over pedal entrapment fears

Pedal entrapment and unintended acceleration are hot-button topics these days, so automakers are always staying alert for potential problems. For Subaru and its newly introduced 2014 Forester, the National Highway Traffic Safety Administration has issued a recall due to improperly manufactured floor mats that could become an obstruction for the gas, brake or clutch pedals. The good news, of course, is that even if drivers experience this problem, the 2014 Forester comes standard with brake override.
At issue with the floor mats on 10,137 Forester models built between January and March of this year is that the resin material used on the underside of the mats can curl when exposed to heat. If the leading edge of the driver's mat curls enough, it can come in contact with the pedals making acceleration, braking and shifting more difficult - possibly resulting in a crash. To fix the problem, Subaru is replacing the entire set of floor mats in all of the affected units. The official NHTSA recall notice is posted below.
