GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Fiero-based Zimmer Quicksilver was objectively terrible, but we'd totally drive it

Now here's something you don't see everyday. It's listed in our classified ads as a 1986 Pontiac Fiero, but as you can see, that description is a bit misleading. In fact, it's a Zimmer Quicksilver, which was indeed built atop the guts of a mid-engine Fiero coupe but was heavily modified by the Zimmer Motorcars Corporation at a facility in Pompano Beach, Florida. And the one you see here actually seems to be a pretty decent deal for a highly unusual car. We're not sure what was a more popular starting point for kit and custom cars in the 1980s and 1990s, but it would have to be either the Fiero or the vintage air-cooled Volkswagen Beetle. Fiero-based machines usually mimicked the design direction of any number of highly desirable Italian stallions, most commonly, we'd guess, the Lamborghini Countach. The Quicksilver is an altogether different animal, with over a foot of extra wheelbase added in front of the A-pillar to make for a dramatic, long and low silhouette that somehow still only has barely enough room for two passengers in its leather- and wood-lined interior. A stock 2.8-liter V6 engine from General Motors is mated to a three-speed automatic transmission that sends 140 horsepower and 170 pound-feet of torque to the rear wheels. Period road tests found the 0-60 run took a little over 10 seconds, which is terrible today but wasn't all that bad for the mid '80s. Best we can tell, only around 170 Quicksilvers were made between 1984 and 1988, which are, not coincidentally, the same years that Pontiac produced the Fiero. The 1986 Zimmer Quicksilver you see here is priced at $18,495 and shows well under 30,000 miles on the odometer. There aren't a lot of Zimmer Quicksilvers currently for sale for us to compare, but the ones we did find that had sold within the last few years suggest a little under $20,000 is a reasonable asking price. Junkyard Gem: 2000 Pontiac Sunfire coupe

In a few months, we'll reach the tenth anniversary of GM's axing of the venerable Pontiac brand. G6s, Vibes, and Matizes continued to be built until 2010, but I'm noticing a marked decrease in discarded Pontiacs lately, as I perform my junkyardy rituals. Here's a 2000 Pontiac Sunfire, photographed in a Colorado wrecking yard. The Sunfire was the near-identical sibling to the Chevrolet Cavalier, based on the long-running (1982-2005) J-Body platform. It was cheap and simple, looked pretty sporty (at least in coupe form), and every parts store in North America carried just about everything you'd need to keep one running. This coupe had to compete for sales not only with a vast and menacing array of imports but with GM's own Saturn SC2 (not to mention the Cavalier itself). Meanwhile, the J platform was showing its age more with each passing year. This car sports what must have been the complete line of Fatal Clothing bomber-nose-art/skate-punk/gang-tag-influenced decals, circa 2010. I actually photographed this car back in 2011, then misplaced the image files until last week. The stickers are very California-centric for a Colorado car, but then plenty of Californians — including me— move here. When you know you're a car's final owner, it's a lot easier to whip out the paint pens and redecorate the interior. Power came from the engine GM developed for the very first J-Bodies: the 2.2-liter 122 pushrod four-cylinder. 2002 was the last model year for 122-powered Sunfires and Cavaliers; the most affordable S-10/Sonoma/Hombre trucks got this engine through 2003.
