Court rejects Carlos Ghosn's request to attend Nissan board meeting

TOKYO — A Japanese court has rejected a request by former Nissan chairman Carlos Ghosn, released on bail last week, to attend the Japanese automaker's board meeting on Tuesday. Nissan dismissed Ghosn as chairman after his Nov. 19 arrest, but he remains on the board. The Tokyo District Court said it rejected Ghosn's request on Monday but did not elaborate on the reasons. It had been unclear whether Ghosn could attend the board meeting. The court's approval was needed based on restrictions imposed for his release on bail. The restrictions say he cannot tamper with evidence, and attending the board meeting could be seen as putting pressure on Nissan employees. Prosecutors had been expected to argue against his attendance. They were not available for immediate comment. Ghosn has been charged with falsifying financial reports in underreporting his compensation and breach of trust in making payments to a Saudi businessman and having Nissan shoulder investment losses. He insists he is innocent, saying the compensation was never decided or paid, the payments were for legitimate services and Nissan never suffered the losses. Since his release on March 6 from Tokyo Detention Center on 1 billion yen ($9 million) bail, he has been spotted taking walks in Tokyo with his family, but he has not made any comments. His attempt to exercise what his lawyer, Junichiro Hironaka, called his "duty" by attending the board meeting signals one way he may be fighting back. Hironaka has said Ghosn will speak to reporters soon. A date for a news conference has not been announced. Nissan said Monday that Renault Chairman Jean-Dominique Senard, Renault Chief Executive Thierry Bollore, Nissan Motor Co. CEO Hiroto Saikawa, and Osamu Masuko, the chairman and CEO of Mitsubishi Motors Corp., will hold a joint news conference Tuesday after the board meeting. Nissan appears determined to highlight new leadership without Ghosn. It is part of an alliance with Renault SA of France, and more recently with Japan's Mitsubishi Motors, that was largely cobbled together by Ghosn, who led Nissan for two decades. Nissan, which makes the March subcompact, Leaf electric car and Infiniti luxury models, has denounced Ghosn for alleged misconduct. A decision at a shareholders' meeting is needed to remove Ghosn from the board. A shareholders' meeting is scheduled for next month.

Internal Nissan emails reportedly corroborate Ghosn's claim of a setup

An internal email trail reportedly supports former boss Carlos Ghosn's claim that Nissan orchestrated his ouster. The leaked emails have been corroborated by sources familiar with their contents, Bloomberg reports.  Emails going back to February 2018, a year before his arrest, allegedly describe a deliberate and multi-pronged effort — a "methodical campaign," Bloomberg said — to remove Ghosn from the company and in so doing, put Nissan in position to negotiate a more favorable relationship with alliance partner Renault.  The initial effort was apparently triggered by Ghosn's announcement in 2018 that he wanted to further intertwine Renault and Nissan, eventually to the point where their integration would be irreversible. Former Ghosn aide Hari Nada, who would appear as the whistleblower figure who outed Ghosn for his alleged financial misconduct, allegedly suggested to a Nissan senior manager that company executives should move to "neutralize his initiatives before itÂ’s too late." Nada would later recommend the termination of the agreement governing the Renault-Nissan Alliance. This would have granted Nissan broader freedom to purchase stake in Renault (or even ultimately take it over entirely), and reduce the French automaker's influence over Nissan's ability to choose its own executives.  The next day, Ghosn was arrested at Haneda Airport in Tokyo on charges of financial misconduct, including personal use of company money and under-reporting of income.  Ghosn, who was released and re-arrested multiple times, fled Japan illegally in January, taking refuge in his former home of Lebanon. Nissan to make 85% of the vehicles it sells here in US

We could be in for a big push from Nissan in the manufacturing realm if Vice President of US Sales and Marketing Fred Diaz has anything to say about it. Speaking to the Automotive Press Association recently, Diaz (above) expressed a desire to build some 85 percent of the vehicles Nissan sells to Americans in the US, claiming it will happen "in the very near future." Nissan has already moved to increase exports of its US-built products, and in 2013, it built just over 76 percent of the models it sold in this market within our country's borders.
"Any issues of us taking advantage of the value of the yen, we want to dispel that," Diaz told reporters, pointing out the contentious issue of currency manipulation. There's also the obvious goal of positive PR - Americans like things made in America, and they like companies that invest in America. Diaz is quick to point out that Nissan had done just that: "While a lot of people retrenched [during the recession], instead we leaned into it and we continued investing and in fact made over $5 billion in investments, bringing a lot of production from Japan to the United States and to Mexico," Diaz said, pointing out that Nissan has helped create 8,000 jobs through its investments.
Nissan runs three factories in the US, two in Tennessee and one in Mississippi. Between the three, production is up 22 percent, while the overall exports from the facilities have increased by 100,000 units, Diaz told reporters.
