Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

Nissan and BMW want the UK to stay in the EU

Nissan and BMW are saying that the Brexit shouldn't become reality. It's a mixture of hope and threat because their planned investments in the UK risk to be damaged by the referendum's result. While those brands are still saying that every decision from the UK's people will be respected, you can sense a fear that every plan is going to be messed up. The problem is simple according to Nissan CEO Carlos Ghosn: "For us, a position of stability is more positive than a collection of unknowns. It makes the most sense for jobs, trade and costs." For sure Nissan is not going to shut its plant in northeast England if the country exits the Union, but this could change plans for the future, as the so-called Brexit could cause an increase on costs and above all on competition. Nissan employs 8,000 people in the UK across its manufacturing, engineering, and design facilities, and a further 32,000 indirectly through dealerships and its supply chain. All these people produce almost half a million cars and 80 percent of those are exported, so just imagine how taxes could affect prices and sales. If the EU's borders get smaller, Nissan will face some problems with customs duties the foreign products struggle with, as other Japanese automakers have so far, while importing their cars into the Union. Nissan is not the only maker interested in the outcome of the referendum to be held June 23; BMW is of the same mood, hoping Brexit won't become reality. The Germans already warn Mini and Rolls-Royce employees that the exit of UK from the Union could cause problems with increasing costs and higher prices due to tariff barriers. BMW CEO Harald Krueger at the Geneva auto show said "a UK vote to exit the European Union would cloud the future of the automaker's UK brands, which include Mini, along with Rolls-Royce". What's happening in this case is not only an English issue. In fact, although every decision taken by the UK's people must be respected, the automakers are right when saying they hope it is not going to happen, as you hope no one changes the cards during the game. Are you the next Nissan Frontier?

A reader of the Phillippine site Autoindustriya.com sent in what appear to be naked spy photos of the pickup that Nissan recently teased first in photo then in video. The shots, one taken from the front and one from the back, have been found on the Nissan Navara Club Thailand forum. The details in the two photos, one from the front and one from the back, match up with the details we can make out from the teaser video, lending credence to the idea that this is indeed the next Nissan Navara, which is essentially the Frontier in overseas markets. Nissan US has reportedly disavowed this as our next Frontier, though; the mysterious photo on Twitter was put there by Nissan Thailand, supposedly the location of these two trucks.
The only other detail submitted with the images is that there's a 2.5-liter turbodiesel under the hood putting out 187 horsepower and 332 pound-feet of torque, running through either a seven-speed automatic transmission or a six-speed manual. The reveal is scheduled for June 11, which is when we should know a lot more about the Navara and how much it is or isn't indicative of what we'll get with the next Frontier, a vehicle we're still not expecting for some time.
