New allegations against Ghosn concern payments to Saudi businessman

BEIJING – Fresh misconduct allegations brought by Tokyo prosecutors against ousted Nissan Chairman Carlos Ghosn center on the use of company funds to pay a Saudi businessman who is believed to have helped him out of financial difficulties, two company sources with knowledge of the matter said. Prosecutors arrested Ghosn for a third time on Friday, accusing him of aggravated breach of trust in transferring personal investment losses to the automaker. The prosecutors' statement said they believe that around October 2008, Ghosn was trying to deal with losses on paper of 1.85 billion yen ($16.6 million) incurred on a swap contract he had with a bank which it did not name. A person helped arrange a letter of credit for Ghosn and a company run by the person later received $14.7 million in Nissan funds in four installments between 2009 and 2012, the statement said, adding that the payments were made in Ghosn's and the person's interests. "By doing so, (Ghosn) behaved in a way that breached trust, and inflicted damage on the property of Nissan," the statement said. The statement also said Ghosn had earlier sought to have Nissan shoulder the appraisal losses directly. According to the Nissan sources who have knowledge of the company's probe into its former chief, the person who helped Ghosn is Khaled Al-Juffali, vice chairman of one of Saudi Arabia's largest conglomerates, E. A. Juffali and Brothers, and a member of the board at the Saudi Arabian Monetary Authority. He is also majority owner of a company called Al-Dahana which owns half of a regional joint venture called Nissan Gulf with the other half held by a wholly owned unit of Nissan Motor. Sheikh Khaled Juffali has no comment on this subject, according to an emailed statement from E. A. Juffali and Brothers. Ghosn's Tokyo-based lawyer, Motonari Otsuru, was unavailable for comment on this article, according to a person who answered the phone at his law office. A representative for the Ghosn family declined to comment. Other media have said Ghosn has through a lawyer denied that he shifted losses to Nissan and has told investigators that the four payments were for legitimate business purposes, including a reward for handling problems at Nissan dealers in Saudi Arabia. Tokyo prosecutors declined to comment. Asked about Ghosn's reported comments, a Nissan spokesman said: "We cannot comment on matters related to Ghosn's arrest for breach of trust.

Lebanon gets Interpol fugitive notice for Carlos Ghosn as escape details emerge

BEIRUT — Lebanon's justice minister said Thursday that Lebanon has received an international wanted notice from Interpol for NissanÂ’s ex-chair Carlos Ghosn, four days after he fled Japan to Lebanon before a trial on financial misconduct charges. Albert Serhan told The Associated Press in an interview that the Red Notice for the former automotive titan was received earlier Thursday by the prosecution. Ghosn skipped bail before his much-anticipated trial, which was to start in April. He arrived in Lebanon, where he was raised after moving from Brazil as a young boy, on Monday via Turkey and hasn't been seen in public since. Authorities have said that he entered legally on a French passport. A plane carrying Ghosn arrived at 5:30 a.m. (0230 GMT) Monday at IstanbulÂ’s Ataturk Airport, Hurriyet reported, adding that prosecutors ordered the arrests after widening their investigation. Flight tracking data from that time suggests that Ghosn used two different planes to fly into Istanbul and then on to Lebanon. Japanese authorities allowed Ghosn to carry a spare French passport in a locked case while out on bail, public broadcaster NHK said on Thursday, shedding some light on how he managed his escape to Lebanon. While some Lebanese media have floated a Houdini-like account of Ghosn being packed in a wooden container for musical instruments after a private concert in his home, his wife called the account “fiction” when contacted by Reuters. She declined to provide details of the exit of one of the most recognized titans of industry. The accounts of the two sources suggest a carefully planned escape known only to a few. They said a private security firm oversaw the plan, which involved shuttling Ghosn out via a private jet to Istanbul before pushing onward to Beirut, with even the pilot unaware of GhosnÂ’s presence on board. InterpolÂ’s so-called Red Notices are requests to law enforcement agencies worldwide that they locate and provisionally arrest a wanted fugitive. Serhan, the minister, said the Lebanese prosecution “will carry out its duties,” suggesting for the first time that Ghosn may be brought in for questioning. Mitsubishi, Nissan will build mini EV together

That minicar project that erstwhile competitors Nissan and Mitsubishi launched about four years ago is about to go a little more maxi. NMKV Co., the joint venture established in June 2011 by the two Japanese automakers to make minicars, is going to get more resources specifically to ease a move into the electric-vehicle sector. Specifically, Nissan, which makes the all-electric Leaf, is going to have a bigger role in the testing, design, and development of the partnership's mini EVs. A memorandum of understand between Nissan and Mitsubishi, maker of the i-MiEV, is in the works. So far, the joint-venture has sold about 500,000 gas-powered three-cylinder compact vehicles under the two automotive brands, so it must be doing something right. The first Nissan Dayz and the Mitsubishi eK Wagon models started production in 2013. Sales of the Nissan Dayz Roox and Mitsubishi eK Space, which went the higher-roof route, began early last year. Nissan and Mitsubishi started making noise about this last summer, when word came out that the little EV may be priced at less than $15,000 in Japan, quite a bit cheaper than either the Leaf or the i-MiEV over there. As with the current models, the future minicar variants will be produced at Mitsubishi's Mizushima factory in Japan. So far, the partnership would only say that details about NMKV's next-generation mini EV will be released "at a later time," so specifics like range and other performance measures will have to wait. The three companies will soon sign a memorandum of understanding. The companies aim to develop more competitive products by optimizing resource allocation and their respective roles and responsibilities. Nissan will be more deeply involved in development operations, such as design development and testing. In addition to its product planning and project development roles, NMKV will strengthen its management capabilities by adding a new department to enhance collaboration with engineering and manufacturing functions.
