Carlos Ghosn sues Nissan-Mitsubishi in the Netherlands

AMSTERDAM — Carlos Ghosn has launched a court case in the Netherlands against Japanese carmakers Nissan Motor and Mitsubishi Motors, who ousted him as chairman of their alliance last year on charges of embezzlement, Dutch newspaper NRC reported on Saturday. Ghosn is seeking 15 million euros ($16.8 million) in damages from the carmakers, as grave mistakes were made when he was sacked, NRC reported, citing his lawyer. "In the Netherlands, if you want to fire an executive you have to first tell him what he's being accused of, and you have to provide him with the evidence for the accusations. Neither of those things has happened," lawyer Laurens de Graaf told NRC. Ghosn fell from grace late last year when he was arrested in Japan and sacked by Nissan on charges of financial misconduct, which he denies. He has also been fired as the CEO and chairman of French carmaker Renault. Ghosn was freed in April from jail in Japan on a $4.5 million bail. Among other charges of fraud and misconduct, Nissan and Mitsubishi have said Ghosn improperly received $9 million in compensation from their joint venture. Suspect expenses Ghosn made when he chaired Renault and Nissan amounted to about 11 million euros, Renault's board said in June. Ghosn holds French, Lebanese and Brazilian citizenship, but opted for the fiscally more friendly Netherlands as his tax domicile in 2012. The holding company for the Nissan-Mitsubishi alliance is also incorporated in the Netherlands. The district court in Amsterdam is reviewing the case but has not set a trial date yet, NRC said. Ghosn says having Apple in EV business would be good news

Nissan once promised to have commercially viable autonomous vehicles on the road by 2020 and even certified a Leaf to test the technology in Japan. The company has since backpedaled a bit from its original lofty claims, though. During CEO Carlos Ghosn's keynote presentation at the Mobile World Congress in Barcelona, Spain, the auto exec talked more about the automaker's strategy and directly confronted Apple's rumored entry into the market. "When Apple says they are going to come with an electric car in 2020, that's good news for us," he said in his speech, according to Adweek. Ghosn took the view that any company able to grow the acceptance of EVs would help every automaker in the segment. The Renault-Nissan Alliance has been at the forefront of developing the market and claimed nearly 60 percent of the global market share last year. He was also the latest auto industry heavyweight to voice his opinion on Apple entering the industry. However, in contrast to former General Motors boss Dan Akerson, the Nissan CEO was much more welcoming. Ghosn also used the speech as a chance to clarify Nissan's plans for autonomous vehicles and seemingly pushed the original goal back by about five years. "In 10 years, you'll have cars without the driver. It is here, and it's going to transform the products," he said, according to Adweek. Under Nissan's current timeline, traffic-jam assist and fully automated parking are due in 2016, followed by automatic lane changing in 2018 and the ability to drive through intersections without a driver's control comes in 2020. Nissan Leaf sales up again in February, Chevy Volt dips deeper

Nissan managed to buck the industry's overall trend of lower sales in February with double-digit growth throughout its lineup. That includes a 12th month of record sales for the Nissan Leaf electric vehicle, with the year-over-year numbers up more than a skosh. The February ledger for the Chevy Volt looked much worse, falling 25.6 percent from February 2013 down to 1,210 units. With 1,425 Leafs sold, Nissan came away the winner in a head-to-head competition between these the two early plug-in vehicles for the fourth month in a row. Nissan expects the Leaf's sales momentum continue in March. February Leaf sales were up 118.2 percent, making 2014 the car's best February ever. The car was most popular in San Francisco, CA and Atlanta, GA, two places where the the brutal winter cold that struck most of the country had a limited effect. Nissan said that other markets with notable Leaf sales growth were Honolulu, HI, Dallas/Ft. Worth, TX and Denver, CO. Toby Perry, Nissan's director of EV sales and marketing, said in a statement that Nissan, "amped up advertising in the latter half of February, which already has resulted in an uptick in sales and a significant increase in shopping traffic. We expect to see that momentum continue in March." The Volt retains an overall sales lead against the Leaf, but Chevy's calendar year-to-date sales numbers are down 23.1 percent so far in 2014. Overall, Chevy's sales calendar YTD numbers were down just 7.7 percent, so the Volt is performing below average.
