Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

Junkyard Gem: 1996 Nissan Quest XE with 338,549 miles

When I hit the junkyard, I always look for vehicles with impressive final figures showing on their odometers. I find so many Hondas and Toyotas with better than 300,000 miles that I don't consider them especially noteworthy (the exception being super-low-spec cheap models, such as a Tercel or Civic VX), and it goes without saying that the bar is quite high for Mercedes-Benzes as well. It has been surprisingly difficult to find discarded Nissans that made it past the 300k mark; today's Junkyard Gem is just the fourth I've documented. The highest-mile junked Nissan I'd found prior to today's minivan is a 1994 Maxima with 364,238 miles, followed by a 1987 Maxima with 341,176 miles and a 1986 200SX with 309,222 miles. Keep in mind that Nissan didn't go to six-digit odometers on most of its US-market cars until the early 1980s, and then went to tough-to-read-in-the-junkyard electronic odometers in the early 2000s; this means the pool of potential high-mile Nissans is limited to about the 1983-2000 range of model years. Ford has just as much right to claim credit to this van's impressive mile total as does Nissan, since the Quest was a collaboration between Ford and Nissan that also produced the Mercury Villager; this van was built by Ford at the Ohio Assembly plant. The Quest/Villager platform was derived from the Maxima's, and the engine is pure Nissan: a 3.0-liter VG30 V6 rated at 151 horsepower. The only transmission available in the first-generation (1993-1999) Quest/Villager was a four-speed automatic. This one appears to have been sold new at Landrum Nissan in Pueblo. The rear glass has been painted flat black, possibly to keep prying eyes from seeing valuable cargo. The rear seats are long gone, so this van probably hauled cargo for much of its long life. The front interior seems to be in good shape. Why is this van here? There's body damage on the left rear and right front, suggesting a crash that may have bent the suspension past the worth-fixing threshold. Nissan hopes to inject some spice into Rogue with 'Open The Briefcase'

Nissan is in the midst of rolling out the redesigned 2014 Rogue and has launched an interesting social media game called Open The Briefcase. The video that launches this game depicts a simple ride-share gone very wrong, with a man getting embroiled in a high-speed chase in a bid to escape with a strange briefcase. Eventually, it all goes haywire, and the man and his driver are captured. The only question seems to be, what's in the briefcase?
The contest, which asks participants to select one of three briefcases by cracking a code, is set to reward three individuals with a new Rogue. New attempts can be made each day, and participants can get additional chances to open a briefcase by sharing the video. The contest kicked off on January 3 and will run until February 14.
