Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

Nissan Leaf is now the best-selling plug-in vehicle of all time in US

Numbers don't lie. And in some instances, you can see their truth from miles away. As everyone expected, the Nissan Leaf is now officially the best-selling plug-in vehicle in the US. While the two vehicles aren't direct competitors (one's a pure EV and the other is a plug-in hybrid), they certainly dominate the plug-in vehicle sales charts. When we do a little math on those charts, we see that since the two vehicles went on sale at the end of 2010, the Volt has sold 75,231 units while the Leaf is now at 76,407, giving the Leaf a 1,176-vehicle lead. The Leaf trailed the Volt by just two units at the end of February. This is the first time the EV had held the overall lead since the end of February 2012, when it was ahead 10,847 to 9,623 and for a while there at the end of 2013, the Volt was up by around 12,000 units. Times have changed, though, and we don't expect the lead to switch back until the next-gen Volt goes on sale later this year, and even then nothing is certain. The Leaf sold 1,817 copies last month, a drop of 27.5 percent from last year. Year-to-date, the Leaf has sold 4,085 units, down 21.2 percent from the same time period in 2014. The Tesla Model S was the best-selling EV of 2015

According to numbers crunched over at Hybrid Cars, the Tesla Model S was the best selling pure electric vehicle last year with 50,366 deliveries. These numbers might not tell the whole story, since Tesla reports deliveries made in 2015 that might have been sold in a different calendar year, while other makers are tallying sales. However, it's inarguable that the Model S ended up in more worldwide driveways than the second-place Nissan Leaf, which did about 43,000 sales. In the US alone, Leaf sales were down 42.8 percent year-on-year, from 30,200 in 2014 to 17,269 last year, and that decline also increased throughout the year. That marks a great finish to a great start to 2015, when Tesla took the lead in EV sales in the US for the first quarter. On top of that, as of last year the Model S becomes the second-best selling EV ever, with 107,148 deliveries since the middle of 2012. It trails the Nissan Leaf, with well over 200,000 worldwide sales. The Chevrolet Volt/Opel Ampera combo takes a close third, with about 106,000 sales. The Nissan and Chevy rivals both launched at the end of 2010, a 16-month head start on the Tesla. Down the charts, the Mitsubishi Outlander PHEV which continues to be forbidden fruit for our market notched 39,000 sales. The BYD Qin PHEV sold 31,898 examples in China, and BYD would take the overall victory from Tesla with 58,728 deliveries if you counted all of its EV and PHEV production, such as its electric buses. The BMW i3 nabbed fourth place with 24,057 global sales. In 2011 the Munich automaker said it wanted to sell 30,000 i3s annually by 2014, but by the time the car launched the company considered 15,000 annual sales 'great for now,' so the 2015 number seems a fine place to wind up.
