2011-2012 Nissan Leaf class-action lawsuit finally settled

In 2012, a group of Nissan Leaf owners sued the automaker in a class-action lawsuit over the "wilting Leaf" issue. That describes the steadily decreasing battery capacity of the electric vehicle's battery pack, which didn't line up with drivers' expectations. At the time, Nissan said the lawsuit was without merit but the legal wranglings continued. A new, $24-million settlement will give Leaf owners a new (not repaired) battery if their current pack drops down to fewer than nine bars of energy capacity. There are also options for 90 days of free charging at some of the No Charge To Charge locations or, if they don't live near any of those, a $50 check. One of the main complaints of the lawsuit was that the initial ads for the EV were less-than-clear, telling people the car could go 100 miles when fully charged but, and here's the problem, the automaker recommended that Leaf owners not charge their cars up all the way in hot climates. The class action suit was filed on behalf of Leaf owners in California and Arizona. It reads, in part: Before purchase or lease, Nissan failed to disclose its own recommendations that owners avoid charging the battery beyond 80% in order to mitigate battery damage and failed to disclose that Nissan's estimated 100 mile range was based on a full charge battery, which is contrary to Nissan's own recommendation for battery charging. Following early reports of the wilting problem in warm climates and the initial filing of the lawsuit, Nissan upgraded its battery warranty. It also improved the EV's battery chemistry. The class action suit says that it's this new chemistry that needs to go into any "wilting Leafs" that are affected by the suit. There's more information at the class-action site. Nissan didn't have much say in merger talks, but it had what FCA wanted

TOKYO — Nissan wasn't consulted on the proposed merger between its alliance partner Renault and Fiat Chrysler, but the Japanese automaker's reluctance to go along may have helped bring about the surprise collapse of the talks. While Nissan Motor Co. had a weaker bargaining position from the start, with its financial performance crumbling after the arrest last year of its star executive Carlos Ghosn, it still had as its crown jewel the technology of electric vehicles and hybrids that Fiat Chrysler wanted. The board of Renault, meeting Thursday, didn't get as far as voting on the proposal, announced last week, which would have created the world's third biggest automaker, trailing only Volkswagen AG of Germany and Japan's Toyota Motor Corp. When the French government, Renault's top shareholder with a 15% stake, asked for more time to convince Nissan, Fiat Chrysler Chairman John Elkann abruptly withdrew the offer. Although analysts say reviving the talks isn't out of the question, they say trust among the players appears to have been broken. "The other companies made the mistake of underestimating Nissan's determination to say, 'No,' " said Katsuya Takeuchi, senior analyst at Mitsubishi UFJ Morgan Stanley Securities in Tokyo. The Note, an electric car with a small gas engine to charge its battery, was Japan's No. 1 selling car, the first time in 50 years that a Nissan beat Toyota and Honda. Renault and Fiat Chrysler highlighted possible synergies that come from sharing parts and research costs as the benefits of the merger. But what Fiat Chrysler lacks and really wanted was what's called in the industry "electrification technology," Takeuchi said. With emissions regulations getting stricter around the world, having such technology is crucial. Yokohama-based Nissan makes the world's best-selling electric car Leaf. Its Note, an electric car equipped with a small gas engine to charge its battery, was Japan's No. 1 selling car for the fiscal year through March, the first time in 50 years that a Nissan model beat Toyota and Honda Motor Co. for that title. Nissan is also a leader in autonomous-driving technology, another area all the automakers are trying to innovate. "Although Nissan had no say, its cautionary stance on the merger ended up being very meaningful," Takeuchi said.

After a surprise debut during the 2015 Super Bowl, Nissan has finally divulged the details on its latest Maxima sedan at the 2015 New York Auto Show. Starting at $32,410 (*not including a $825 destination charge), the Maxima retains the current car's powertrain, featuring a 3.5-liter V6 and a continuously variable transmission. Unlike its predecessor, though, the new fullsizer boasts 300 ponies, up from 290. While the power figures and displacement of the new V6 are similar to last year's model, Nissan claims over 60 percent of the parts in the new 3.5 are new. That means not only more power, but a 15-percent improvement in highway fuel economy, with the Maxima estimated to hit 30 miles per gallon. The CVT is also new, with Nissan claiming it's now "performance oriented." Beyond the oily bits, the cabin is home to an eight-inch touchscreen, while drivers will enjoy a seven-inch display in the instrument cluster. In terms of safety tech, Nissan installed the standard alphabet soup of acronyms, offering up Predictive Forward Collision Warning (PFCW), adaptive cruise control, Forward Emergency Braking (FEB), and blind-spot warning with cross-traffic alert. As we said, the Maxima will start at $32,410, and will be offered in four grades, with the Platinum trim remaining at the very top of the line.
