Nissan Silvia smuggler faces maximum 20-year, $250k sentence

Thinking about trying to sneak a JDM car into the United States? Better think twice, because according to the Clarion-Ledger, one man in Mississippi has found himself in hot water for smuggling a Nissan Silvia into the country. Few details of the case are available, but the Silvia has a strong following among JDM enthusiasts despite (or perhaps because of) the fact that it was never officially sold Stateside. The low-slung coupe was offered in Japan and other markets from 1964 through 1968 and again from 1974 to 2002. Though it was powered principally with a four-cylinder engine, its front-engine/rear-drive layout made it popular on the tuning and drifting scenes. The 240SX that was offered Stateside was related, but not strictly speaking the same vehicle. It's likely because the Silvia was never certified for use on American roads (and because the culprit apparently didn't go through the correct channels) that the unidentified man in Ocean Springs, MS, is reportedly facing a $250,000 fine and up to 20 years in prison. Here's hoping whatever else he's got in the driveway is just as fast, because it looks like he'll have a lot of time to make up for. Nissan and Carlos Ghosn settle SEC claims over undisclosed compensation

WASHINGTON — Nissan and its former Chief Executive Carlos Ghosn have agreed to settle claims from the U.S. Securities and Exchange Commission over false financial disclosures related to Ghosn's compensation, an SEC statement said on Monday. Nissan will pay $15 million, while Ghosn agreed to a $1 million civil penalty and a 10-year ban from serving as an officer or director of a publicly traded U.S. company, the SEC statement said. Ghosn was arrested in Japan and fired by Nissan last year. He is awaiting trial in Tokyo on financial misconduct charges that he denies. Former Nissan human resources official Gregory Kelly agreed to a $100,000 penalty and a five-year officer and director ban. Nissan, Ghosn, and Kelly settled without admitting or denying the SEC's allegations and findings. The SEC said in total Nissan in its financial disclosures omitted more than $140 million to be paid to Ghosn in retirement — a sum that ultimately was not paid. The SEC also accused Ghosn in a suit filed in New York that he engaged in a scheme to conceal more than $90 million of compensation. That suit is being settled as part of the agreement announced Monday. Nissan confirmed it had settled the allegations and said it "is firmly committed to continuing to further cultivate robust corporate governance." Nissan provided significant cooperation to the SEC, the agency said. The company now has a new governance structure with three statutory committees — audit, compensation and nomination — and has amended its securities reports for all relevant years. The SEC said beginning in 2004 Nissan's board delegated to Ghosn the authority to set individual director and executive compensation levels, including his own. The SEC said "Ghosn and his subordinates, including Kelly, crafted various ways to structure payment of the undisclosed compensation after Ghosn's retirement, such as entering into secret contracts, backdating letters to grant Ghosn interests in Nissan's Long Term Incentive Plan, and changing the calculation of Ghosn's pension allowance to provide more than $50 million in additional benefits." "Investors are entitled to know how, and how much, a company compensates its top executives. Ghosn and Kelly went to great lengths to conceal this information from investors and the market," said Stephanie Avakian, co-director of the SEC's Division of Enforcement.

The all-electric Renault Zoe sold 10,000 units during its first year on sale and the French automaker has sold a total of about 51,500 EVs since starting sales of its four-vehicle EV lineup in 2011. Throw in the fact that the Nissan Leaf has sold around 150,000 around the world and some sales of the e-NV200 delivery van, and we get to a banner headline for the Renault-Nissan Alliance: the companies have sold over 200,000 EVs since the Leaf went at sale in the end of 2010. The Alliance announced it crossed the 100,000 EV sales mark in July 2013, so we can calculate that the two companies are selling roughly 6,250 EVs a month, with the Leaf making up the bulk of that figure (the car is averaging around 3,000 units a month in the US alone). Nissan says that Leaf has cumulatively sold around 67,000 Leafs in the US, 46,500 in Japan and 31,000 in Europe. The 6,250 sales per month is a rough estimate, since the Alliance says its sales are up 20 percent this year compared to last. Still, all told, Renault-Nissan claims it has 58 percent of the global market share for EVs, and its battery-powered vehicles have driven four billion kilometers (2.48-billion miles), which has prevented 450 million kilograms of CO2 from entering the atmosphere.
