Dutch court orders Ghosn to repay Nissan-Mitsubishi $6 million in wages

AMSTERDAM — A court in Amsterdam on Thursday ordered fugitive former car executive Carlos Ghosn to repay Nissan and Mitsubishi almost 5 million euros ($6.1 million) in wages he received from their Dutch registered joint venture Nissan-Mitsubishi BV in 2018. Nissan and Mitsubishi, which ousted Ghosn as chairman of their companies and of their joint venture after his arrest for financial misconduct in 2018, claimed Ghosn had wrongly granted the wages to himself. Ghosn had brought the case himself, demanding 15 million euros in compensation for missed wages and severance payments as he claimed Nissan and Mitsubishi had violated Dutch labor laws when they dismissed him from the Amsterdam-based joint venture in 2019. But the district court in Amsterdam sided with the car companies, stating that Ghosn did not have a valid employment agreement with the joint venture, as it lacked the required consent of the boards of Nissan and Mitsubishi. The amount Ghosn needs to repay equals the net payments he received from the joint venture between April and November 2018, the court said. Ghosn, who has denied wrongdoing, was chairman of both Nissan and Mitsubishi and chief executive of Renault when he was arrested in Japan in 2018 on charges of underreporting his salary and using company funds for personal purposes. He fled to Lebanon in December 2019 hidden in carry-on luggage on a private jet that flew out of Kansai Airport, and has remained in that country since. Nissan pulled planned reveal of longer-range Leaf from L.A.

The arrest and detention of its former chairman, Carlos Ghosn, prompted Nissan at the last minute to pull the plug on plans to debut a longer-range version of its Leaf battery- electric car at the Los Angeles auto show, The Wall Street Journal reports. Nissan instead showed two mild-refresh models for 2019 — the Maxima sedan and the Murano crossover. It had reportedly hoped to make a bigger splash by unveiling the upgraded Leaf with actress and brand ambassador Margot Robbie at a media event at the Japanese American National Museum. It went ahead with an event at the venue, showing current models of the Leaf and holding the Nissan Futures event, the first time the series of panel discussion and keynote addresses had been staged in the U.S., with Robbie sitting down for a brief interview about owning an EV and sustainability issues. "The official announcement regarding details of the 2019 Nissan Leaf with additional performance capabilities is postponed to a later date," the company said in a statement. A spokesman told the Journal the postponement was "to ensure that this important product unveiling could receive the coverage it merits." Ghosn was arrested Nov. 19 in Japan on allegations of financial misconduct, including what Nissan has said was personal use of company money and deliberately under-reporting what he had been paid. Both Nissan and alliance partner Mitsubishi have ousted Ghosn as chairman, though his status remains unchanged for now at Renault, the third member of the partnership where he is both chairman and CEO. Renault has appointed a stand-in replacement while Ghosn remains in custody. Reuters reports that Tokyo authorities extended Ghosn's detention a second time Friday and have until Dec. 10 to file charges or release him. The auto world has been widely anticipating a longer-range version believed to be called the Leaf E-Plus, with a 60-kWh battery pack and an expected driving range of around 225 miles, up from the 40-kWh battery and 151-mile driving range of the current model. A recent report suggests that its starting price will be about $5,500 more than the 40-kWh version, meaning around $36,385 before federal EV tax credits. A spokesman tells Autoblog the postponement doesn't affect the new Leaf's on-sale date but added that date has yet to be announced.

Carlos Ghosn 'surprised' by reports of French international arrest warrant

PARIS - Carlos Ghosn, the former car executive at the helm of Renault and Nissan, was "surprised" by earlier media reports which stated that French prosecutors had issued an international arrest for him, said a spokesperson for Ghosn. "This is surprising, Ghosn has always co-operated with French authorities," a spokesperson for Ghosn told Reuters. The spokesperson for Ghosn was reacting after the Wall Street Journal and French media reported that French prosecutors had issued an international arrest warrant for Ghosn. An investigating magistrate issued five international arrest warrants against Ghosn and the current owners or former directors of the Omani company Suhail Bahwan Automobiles, a vehicle distributor in Oman, the prosecutor’s office in the Paris suburb of Nanterre said to The Wall Street Journal. They allege Ghosn funneled millions of dollars of Renault funds through the Omani car distributor for his personal use, including for the purchase of a 120-foot yacht. The local prosecutor for Nanterre could not be immediately reached for comment. Ghosn told Reuters in an interview last year that he was prepared for a lengthy process to clear his name with French authorities, and vowed to challenge an Interpol warrant that is barring him from travel outside of Lebanon.
