What to expect from the Japanese trial of Nissan and Greg Kelly

TOKYO — The criminal trial against Japanese automaker Nissan and its former executive Greg Kelly will open in Tokyo District Court on Tuesday. ItÂ’s the latest chapter in the unfolding scandal of Carlos Ghosn, a superstar at Nissan until he and Kelly were arrested in late 2018. Five questions and answers about the trial: Q: WHAT ARE THE ALLEGATIONS? A: The charges center around KellyÂ’s role in alleged under-reporting of GhosnÂ’s future compensation by about 9 billion yen ($85 million), a violation of financial laws. Kelly says he is innocent. Nissan, which is also similarly charged, has already acknowledged guilt, made corrections to the compensation documents submitted to the authorities, and has started paying a 2.4 billion yen ($22.6 million) fine. Q: WHAT HAPPENS TO GHOSN? A: Probably nothing. He skipped bail late last year and is now in Lebanon, which has no extradition treaty with Japan. Two Americans, Michael Taylor and his son Peter Taylor are being held in Massachusetts without bail, suspected of having helped Ghosn escape by hiding in a box on a private jet. A U.S. judge recently approved their extradition to Japan. The case is now before the U.S. State Department. Q: HOW DO CRIMINAL TRIALS PROCEED IN JAPAN? A: The trial, before a panel of three judges, is expected to take about a year. There is no jury. Juries are selected only for extremely serious cases in Japan, such as murder. In principle, there are no plea bargains although backroom deals are made all the time. Closed pre-trial sessions are held ahead of the trialÂ’s opening, often for months before the real trial begins. Japan's legal system has come under fire from both within and outside the country as “hostage justice” because suspects often are held for months and interrogated without a lawyer present, often leading to false confessions, according to critics. Q: WHAT ARE KELLYÂ’S CHANCES? A: More than 99% of criminal trials in Japan result in a conviction. Japanese Justice Minister Masako Mori, in an online presentation in English hosted by the Japanese Embassy in the U.S., argued the conviction rate is so high because Japan prosecutes only about a third of the cases that come up, choosing only those that “result in guilty verdicts.” She insisted there is a “presumption of innocence.” She declined comment on KellyÂ’s case.

Nissan Leaf EVs slip through French village to make a quiet point

Bjork's 1995 freak-out hit It's Oh So Quiet may have reflected the singer's oddball Icelandic sensibilities, but Nissan is making the concept of relative silence a French thing. The Japanese automaker recently promoted its all-electric Leaf by staging a mini-rally through what it called "one of the quietest villages in Europe." And with the exception of a couple damaged trash bins and a destroyed rear-view mirror from an old-school archway, the race kept the drivers wide awake but everyone in the Southern French village in Provence Alpes Cote d'Azur sleeping. Nissan sent four vehicles on a five-kilometer jaunt through the village in the wee morning hours. Screeching tires and a couple booms notwithstanding, the company said everyone in town stayed snoozing. There was a broader purpose to this exercise, of course, which Nissan blatantly admits was a stunt. Nissan was helping celebrate 19th Annual International Noise Awareness Day (INAD), which took place on Wednesday and highlighted the emotional and health issues as well as high blood pressure and insomnia caused by excessive exposure to noise. NISSAN LEAF CELEBRATES INTERNATIONAL NOISE AWARENESS DAY WITH A NIGHTTIME "SILENT RIDE" ROLLE, Switzerland – To mark the 19th annual International Noise Awareness Day (INAD), Nissan has taken to the streets of one of Europe's quietest villages during the middle of the night with a silent "ride" of its 100 percent electric Nissan LEAF. The World Health Organization (WHO) states at least 13.5 percent of Europeans are exposed to road traffic noise at levels exceeding 55 dB, which is considered detrimental to human health*. The medical effects of noise levels include insomnia (50dB), obesity (50dB), psychic disorders (60dB) and reduction in life expectancy (50dB)*. As a result, Nissan has filmed a 'silent ride' to help support INAD in raising awareness about noise pollution levels across Europe.

Should you buy an EV?

The EV market is poised to become a lot more sophisticated over the next 18 months with the three leading manufacturers – Tesla, General Motors, and Nissan – launching five brand new models along with no fewer than 16 other manufacturers making many of their bread and butter cars available as plug-in hybrids. So let's begin with the most important question. What's Your Range? How much driving do you generally do in a day? If the answer to that question is 50 miles or fewer, an all-electric vehicle like the Nissan Leaf may be the best ingredient for your driving recipe. This is especially true if you have a second vehicle you can use for the occasional longer drive or are willing to rent for the weekend. But here's a little surprise for you. The upcoming Chevy Volt was designed to be driven in all-electric mode for over 50 miles. Fifty-three, to be exact. Plus, the Volt's battery has experienced a lot fewer deterioration issues than the Nissan Leaf's due in part to the Volt's liquid-cooled battery, which also uses a lot less of its capacity than the air-cooled Leaf's does.
