Carlos Ghosn's lawyers in Japan quit after client's flight to Lebanon

TOKYO — Japanese attorneys representing Carlos Ghosn, including lead lawyer Junichiro Hironaka, quit on Thursday following the former Nissan chiefÂ’s flight to Lebanon from Japan, where he had been fighting financial misconduct charges. Hironaka had been representing Ghosn in his defense against financial misconduct charges. His move, announced Thursday, was widely expected after Ghosn escaped to Lebanon late last month. A second lawyer in GhosnÂ’s three-person legal team, Takashi Takano, also quit on Thursday, according to an official at his office. A person who answered the telephone at the office of the third lawyer, Hiroshi Kawatsu, said she did not know if he still represented the former automotive executive. Hironaka said in a statement that the entire team working on the case at his office will quit but did not outline reasons. He has said before he felt some empathy for Ghosn's reasons for escape, while stressing he had hoped to win vindication in court. Hironaka is respected for winning high-profile cases in this nation where the conviction rate is higher than 99%. Among the cases he has handled is that of Atsuko Muraki, a Welfare Ministry official accused of falsely approving a group to qualify for mail discounts. She was acquitted in 2010. Also Thursday, Nissan released steps it was taking to prevent a recurrence of Ghosn's scandal, and reiterated its denouncement of Ghosn. The automaker said in a report submitted to the Tokyo Stock Exchange that Ghosn had the authority to “single-handedly” determine directors' compensation and such information was not shared with other departments at the company. The underreporting of his future compensation is among the allegations Ghosn faced in Tokyo. In a news conference last week in Beirut, Ghosn insisted again that he was innocent of the charges, which also included breach of trust in diverting Nissan money for his personal gain. He said he fled because he felt he could not expect a fair trial in Japan. Ghosn's flight while he was out on bail awaiting trial means his case will not go on in Japan. Interpol has issued a wanted notice but his extradition from Lebanon is unlikely. Ghosn has accused Nissan and Japanese officials of conspiring to bring him down to block a fuller integration of Nissan with its French alliance partner Renault SA of France. Ghosn, who has signed on an international team of lawyers, has expressed willingness to stand trial in Lebanon.

As the chief executive of both Renault and Nissan, Carlos Ghosn is one of the most powerful executives in the automotive industry. But at 60, he'll have to retire sooner than later: he's got three and a half years left on his contract at Renault, which mandates retirement by 65. But before his time is up, he intends to leave the Renault-Nissan Alliance among the top three automakers in the world. Currently the combined sales of Nissan, Renault and its various brands (including Dacia, Datsun and Infiniti) make the alliance the fourth largest carmaker globally, trailing behind Toyota, Volkswagen and General Motors, but ahead of Hyundai, Ford, Fiat Chrysler and Honda. But Ghosn sees the alliance's sales (and global market share) increasing in the next three years. Speaking with Automotive News Europe, Ghosn projected confidently that the alliance will hit the number three spot by 2018 – just three years from now. To get there, Ghosn knows that Nissan and Infiniti will need to increase their combined market share to 10 percent in the United States, growing around 2 to 3 percent each year between now and 2018. The challenge is that much more evident in North America where only half of the alliance participates. But it's not all about America. Ghosn also the Chinese market as equally vital to the alliance's success and that of its constituent automakers, projecting continued growth in China for the foreseeable future. He's also banked heavily on the Russian market, which may have dipped now, but in Ghosn's view is bound to recover. Spitballs flying between Nissan and Fiat

At the 2012 LA Auto Show, Fiat brand chief and recently crowned marketing genius, Olivier François, attempted to distance the Fiat 500e from other electric vehicles, asking rhetorically, "Isn't ugliness the worst kind of pollution?" Nissan has apparently taken issue with these comments, feeling slighted for what it considers digs at the Leaf's styling. In a recent interview with Automotive News, Nissan's marketing chief Simon Sproule shot back, "Let's face it, Fiat has not shied away from controversial styling themselves," he continued, "many would describe many of their products as visual pollution." Ouch.
Sproule says that while the 500e is a "me-too" product, made only to appease US emissions regulations, the Leaf is a serious effort at producing an EV. The Nissan marketing boss points out that the Japanese automaker has invested billions in EV development and production facilities, while Fiat will lose $10,000 on every 500e sold.
However sales of the Leaf in the US are down five percent. Nissan sold just 8,330 Leaf's so far this year, but Sproule contends that it has less to do with styling, and more with the charging infrastructure. Sproule also thinks that Nissan hit a balance between styling and practicality with the Leaf: "It's still very recognizable as a five-seat hatchback, fully functioning, absolutely competitive with the packaging of the Golf of any other mainstream vehicle."
