Lebanon has 40 days to figure out what to do with Carlos Ghosn

BEIRUT — Lebanon and Japan have about 40 days to decide whether ousted Nissan boss Carlos Ghosn will be extradited to Japan or stand trial in Lebanon, a judicial source and a source close to Ghosn said on Thursday, following his escape from Japan. Ghosn fled to Lebanon, his childhood home, as he was awaiting trial on charges of under-reporting earnings, breach of trust and misappropriation of company funds, all of which he denies. Japan and Lebanon have no extradition agreement, and Lebanon does not typically hand over its nationals. Ghosn's legal team is hoping to hold the trial in Lebanon, where the former auto executive has deep ties and hopes to clear his name. Japan has in recent days asked Lebanon to clarify what files Tokyo needs to send as part of an official extradition request, the two sources said. "They came back and requested a clarification. Today, we sent that to the Japanese," the judicial source said. That communication is significant because, according to Lebanon's rules for dealing with Interpol notices, it triggers a roughly 40-day period by the end of which agreement must be reached between the countries on where and how Ghosn will stand trial, the sources said. Japan must now either send a formal extradition request to Lebanon or send Ghosn's file to Beirut and agree on a process for trying him there, the source close to Ghosn said. An Interpol spokesperson said on Friday the organization did not itself dictate a timeframe or require any action to be taken by countries and such a framework is set locally. Ghosn, who holds Lebanese, French, and Brazilian nationality, was questioned earlier this month by Lebanese prosecutors who confiscated his passport and imposed a travel ban as part of the Interpol arrest warrant process. The source close to Ghosn said the former executive can appeal to Lebanon's prosecutor to drop the ban and return his passport if Japan does not respond within the timeframe. Japanese prosecutors have said they are still pushing for Ghosn to be tried in Japan. Ghosn has struck out at what he has called Japan's unjust judicial system and said the alternative to fleeing would have been to spend the rest of his life languishing in Tokyo without a fair trial. New allegations against Ghosn concern payments to Saudi businessman

BEIJING – Fresh misconduct allegations brought by Tokyo prosecutors against ousted Nissan Chairman Carlos Ghosn center on the use of company funds to pay a Saudi businessman who is believed to have helped him out of financial difficulties, two company sources with knowledge of the matter said. Prosecutors arrested Ghosn for a third time on Friday, accusing him of aggravated breach of trust in transferring personal investment losses to the automaker. The prosecutors' statement said they believe that around October 2008, Ghosn was trying to deal with losses on paper of 1.85 billion yen ($16.6 million) incurred on a swap contract he had with a bank which it did not name. A person helped arrange a letter of credit for Ghosn and a company run by the person later received $14.7 million in Nissan funds in four installments between 2009 and 2012, the statement said, adding that the payments were made in Ghosn's and the person's interests. "By doing so, (Ghosn) behaved in a way that breached trust, and inflicted damage on the property of Nissan," the statement said. The statement also said Ghosn had earlier sought to have Nissan shoulder the appraisal losses directly. According to the Nissan sources who have knowledge of the company's probe into its former chief, the person who helped Ghosn is Khaled Al-Juffali, vice chairman of one of Saudi Arabia's largest conglomerates, E. A. Juffali and Brothers, and a member of the board at the Saudi Arabian Monetary Authority. He is also majority owner of a company called Al-Dahana which owns half of a regional joint venture called Nissan Gulf with the other half held by a wholly owned unit of Nissan Motor. Sheikh Khaled Juffali has no comment on this subject, according to an emailed statement from E. A. Juffali and Brothers. Ghosn's Tokyo-based lawyer, Motonari Otsuru, was unavailable for comment on this article, according to a person who answered the phone at his law office. A representative for the Ghosn family declined to comment. Other media have said Ghosn has through a lawyer denied that he shifted losses to Nissan and has told investigators that the four payments were for legitimate business purposes, including a reward for handling problems at Nissan dealers in Saudi Arabia. Tokyo prosecutors declined to comment. Asked about Ghosn's reported comments, a Nissan spokesman said: "We cannot comment on matters related to Ghosn's arrest for breach of trust.

Nissan sets 2017 sales record with help from Rogue, Titan, and Armada

Nissan Group said its U.S. sales climbed 1.9 percent in 2017 to an all-time record of more than 1.59 million vehicles sold. Free pizza in the conference rooms in Nashville, right? But a closer look shows the company mirroring overall industry trends, with plenty of declining-popularity cars but also a few aging trucks and SUVs. Taken together, Nissan's trucks, SUVs and crossovers saved the day, selling an all-time high of 765,624 total units, up 15 percent from 2016. That offset a 10.9-percent drop in sales of Nissan's cars, as volume sellers like the Altima and Versa posted steep drops. Also buoying overall results was the Infiniti division, which gained 10 percent from the previous year on the strength of models like the Q60 and QX30. Nissan's record year owes a lot to the Rogue, its compact crossover, which set an annual sales record with 403,465 vehicles, an increase of 22.3 percent. Sales of the Titan, Nissan's full-size pickup, grew an impressive 141.9 percent to 52,924 units, while the Armada, a full-size three-row SUV that was all-new for 2017, also saw a huge jump in sales (154.1 percent) to 35,667. Infiniti, meanwhile, saw overall sales climb 10.9 percent on the strength of huge gains by the Q60 Coupe, which rose 170.8 percent, and the QX30 crossover, which grew almost 524 percent. That being said, Infiniti volume is relatively low. The Q60 Coupe sold a total of 40,444 units and the QX30 14,093 for 2017, while Nissan shifted 40,172 Rogues in December alone. On the car side, the Maxima did well, gaining 7.9 percent to finish at 67,627. Volume-wise, the Sentra dominated, nudging up 1.7 percent to 218,451. But the rest of the lineup mirrored industry trends for the car segment, with steep drops for the Altima (down 17 percent), battery-electric Leaf (-19.8 percent), Versa (-19.2 percent) and Juke (-48.1 percent). Several truck, crossover and SUV models are also not faring so well. The aging Frontier pickup, last updated in 2005, fell 14.5 percent, the Pathfinder slipped by 0.8 percent, the Quest minivan plummeted 55.5 percent and the upscale Murano crossover fell by 11.8 percent. A Nissan spokesman says the Quest is no longer being built for the U.S. market starting with the 2018 model year. Meanwhile, reinforcements are coming. Nissan has said it's planning a new generation of the Frontier, its entry-level pickup, but hasn't clarified when.
