Carlos Ghosn appears in court: 'I am wrongly accused'

TOKYO — Former Nissan Chairman Carlos Ghosn told a Tokyo court on Tuesday that he was innocent, defending his honor in his first public appearance since he was arrested on Nov. 19 and charged with false financial reporting. "Your honor, I am innocent of the accusations against me," Ghosn told the judge, speaking firmly and calmly as he read from a statement. "I am wrongfully accused." Prosecutors have charged Ghosn, who led a dramatic turnaround at the Japanese automaker over the past two decades, with falsifying financial reports in underreporting his income by about 5 billion yen ($44 million) over five years through 2015. They also say he is suspected of having Nissan temporarily take on his investment losses from the financial crisis. Seen for the first time since his November arrest, Ghosn was wearing a dark suit without a tie, and plastic slippers, and looked thinner and with gray hair. He rebutted the allegations against him point-by-point and said he had the option to leave Nissan but had decided to stay on. "A captain doesn't jump ship during a storm," he told the court in a strong voice. The veteran auto executive, a familiar face at the World Economic Forum and other elite gatherings, was handcuffed and led into the courtroom with a rope around his waist as the hearing began. Officers uncuffed him and seated him on a bench. Presiding judge Yuichi Tada then read out the charges and said Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, was considered a flight risk — he was arrested on his arrival in Tokyo by private jet — and might try to hide evidence. In Japan, suspects are routinely held without bail, often due to fears about evidence tampering. During Tuesday's hearing, Go Kondo, one of Ghosn's lawyers, argued he was not a flight risk. "He's widely known so it's difficult for him to escape. There is no risk that the suspect will destroy evidence," he said. Facing the courtroom, Ghosn spoke proudly of the automaker's — and his own — achievements, such as reviving iconic models like the GT-R and the Z, expanding operations in China, Russia, Brazil and India and pioneering electric cars and autonomous driving. "I have a genuine love and appreciation for Nissan," he said. Ghosn has been held in spartan conditions at a Tokyo detention facility since he was taken into custody. In keeping with Japanese regulations, he has been allowed visits only from his lawyers and consular officials.

Vermont electric utility Green Mountain Power is selling discounted Tesla Powerwalls to its customers in hopes of balancing the grid. The battery packs would be used not just to help customers store renewable energy for home solar systems or as backup power, but also to occasionally discharge power back to the grid when needed. In addition to this decentralized energy storage being useful to customers, it also benefits the utility by taking demand off energy generating infrastructure during periods of peak demand. Together, Nissan and Renault have built 340,000 electric cars. The allied Japanese and French automakers hit 100,000 EVs in July 2013, 200,000 in November 2014, and a quarter million in June of 2015. The Nissan Leaf, which first went on sale at the end of 2010, makes up the bulk of the EVs the Renault-Nissan Alliance has sold. Renault delivered its 50,000th Zoe EV in April 2016. Leaf sales have declined in the US in recent months, due at least in part to the anticipation of the Chevrolet Bolt and Tesla Model 3. Students at the Bearys Institute of Technology (BIT) in Karnataka, India have built what they call the Hybrid Water Car. The car uses a system to electrolyze hydrogen from water and add it to the fuel for more efficient combustion. The system has been placed into a chopped up, lightweighted Maruti Omni. While the benefits of onboard hydrogen electrolyzers have been debated for some time, the BIT students don't plan to stop there, as their next project car will be fueled completely by hydrogen. Recharge Wrap-up: Fiat 500X emissions, Japan EV sales down

The Fiat 500X exceeds EU emissions limits, according to environmental lobby group DUH. In dyno tests, DUH found NOx emissions in the diesel-powered 500X to be 11 to 20 times the limit with a warm engine, but closer to the limit with a cold engine. Testing of vehicles from Fiat and other automakers "point towards defeat devices," says DUH campaigner Axel Friedrich. Fiat Chrysler Automobiles (FCA) offered no comment in response to the accusations. Read more from Reuters. A UK study finds that about 20 percent of the benefits from fuel efficient vehicles are negated by a tendency for people to drive them more. The study, which covers the years 1970 to 2011, finds a significant "rebound effect," when consumers use more of a cheaper energy source. It suggests these drivers drive more not because of the fuel efficiency, but because of the lower operating costs. "Until now, we didn't know the size of this effect for British motoring," says Dr. Lee Stapleton, Research Fellow for the University of Sussex Centre on Innovation and Energy Demand. Japanese EV sales have declined for the first time ever. Sales of electric vehicles slid 22 percent in 2015, leaving them at the same levels as 2012. Low gasoline prices are to blame, as well as the late arrival of the updated Nissan Leaf, which caused potential customers to hold off on their purchase. This allowed the Mitsubishi Outlander PHEV to take the lead as Japan's best selling EV. The Toyota Prius Plug-In came in third place in EV sales, with the BMW i3 close on its heels.
