Internal Nissan emails reportedly corroborate Ghosn's claim of a setup

An internal email trail reportedly supports former boss Carlos Ghosn's claim that Nissan orchestrated his ouster. The leaked emails have been corroborated by sources familiar with their contents, Bloomberg reports.  Emails going back to February 2018, a year before his arrest, allegedly describe a deliberate and multi-pronged effort — a "methodical campaign," Bloomberg said — to remove Ghosn from the company and in so doing, put Nissan in position to negotiate a more favorable relationship with alliance partner Renault.  The initial effort was apparently triggered by Ghosn's announcement in 2018 that he wanted to further intertwine Renault and Nissan, eventually to the point where their integration would be irreversible. Former Ghosn aide Hari Nada, who would appear as the whistleblower figure who outed Ghosn for his alleged financial misconduct, allegedly suggested to a Nissan senior manager that company executives should move to "neutralize his initiatives before itÂ’s too late." Nada would later recommend the termination of the agreement governing the Renault-Nissan Alliance. This would have granted Nissan broader freedom to purchase stake in Renault (or even ultimately take it over entirely), and reduce the French automaker's influence over Nissan's ability to choose its own executives.  The next day, Ghosn was arrested at Haneda Airport in Tokyo on charges of financial misconduct, including personal use of company money and under-reporting of income.  Ghosn, who was released and re-arrested multiple times, fled Japan illegally in January, taking refuge in his former home of Lebanon. Ghosn flight prompts renewed focus on Japan's strict justice system

TOKYO — Carlos Ghosn's daring flight from Japan, where he was awaiting trial on charges of financial wrongdoing, has revived global criticism of the nation's "hostage justice," but in Japan is prompting talk of reversing more lenient curbs on defendants. The ousted boss of Japan's Nissan and France's Renault fled to Lebanon, saying on Tuesday that he had "escaped injustice" and would "no longer be held hostage by a rigged Japanese justice system." Ghosn was first arrested in November 2018 when his private jet landed in Tokyo and kept in jail for more than 100 days as prosecutors added more charges, all of which he has denied. He was released on $9 million bail in March — only to be arrested and bailed again the following month. He was facing four charges, including underreporting his Nissan salary and transferring personal financial losses to his employer's books while he ran Japan's No. 2 automaker. His apparent escape from Japan's legal system — Tokyo and Lebanon don't have an extradition treaty — will likely halt or even reverse a trend of recent years toward granting bail in more cases, said Colin Jones, a law professor at Doshisha Law School in Kyoto. “I would expect it to be more difficult for foreign defendants to get bail,” Jones said. In Japan, suspects who deny the charges against them are often detained for long periods and subject to intense questioning without a lawyer present, a system critics call "hostage justice." Japanese civil rights groups and the main bar lawyers association have long criticized a system that convicts 99.9% of criminal defendants. They say it gives too much power to prosecutors, who can detain suspects for long periods before indictment, and relies too much on confessions, some later found to have been forced and false. Ghosn's escape is clearly a shock to Japan's legal establishment. "This case raises the extremely serious issue of whether it's all right to continue the trend toward bail leniency," said former prosecutor Yasuyuki Takai. "The legal profession and lawmakers need to quickly consider new legal measures or a system to prevent such escapes," Takai, who was formerly with the special investigation unit of the prosecutor's office, told public broadcaster NHK.

Nissan may take control of struggling Mitsubishi Motors

Reports say Nissan will buy a controlling stake in Mitsubishi Motors, either 30 or 34 percent, for about 200 billion yen or $1.84 billion. Nissan and Mitsubishi motors are currently part of a joint venture, NMKV, to build minicars together. Nissan is also responsible for reporting fuel-economy discrepancies with cars built under the joint-venture agreement, which put Mitsubishi in its current weakened state. Earlier today, reports surfaced that the fuel-economy issues were wider ranging than originally thought. Mitsubishi now admits that all of its Japanese-market cars sold since 1991 could have had faked fuel-economy data. Shares of Mitsubishi Motors have dropped by about half since the scandal was uncovered, opening the door for a takeover. While Nissan is a much larger company, it can benefit from Mitsubishi's 60-percent share of Japan's minicar market. The two companies also had plans to build electric vehicles together in the joint venture.
