Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

US approves extradition of Americans accused of arranging Carlos Ghosn's escape

In the latest chapter of ex-Nissan CEO Carlos Ghosn's dramatic downfall, two Americans are about to face Japan's notoriously tough justice system. The US State Department has approved the extradition of Michael and Peter Taylor, who are accused of helping Ghosn flee Japan, reports the Associated Press. Ghosn was under house arrest in Japan, awaiting trial for alleged financial malfeasance during his tenure as head of Nissan and the Renault-Nissan Alliance. In December 2019, Michael Taylor (pictured), a former member of the US Special Forces, and his son Peter, allegedly smuggled Ghosn out of Japan in a musical instrument case on two charter flights, from Japan to Turkey, and then from Turkey to Ghosn's childhood home of Lebanon. According to the AP, the Taylors received two payments from the Ghosn family totaling $1.36 million (one to Peter Taylor's company and the other in cryptocurrency). Michael Taylor ran a business security firm after retiring from the US Army. The Taylors have been in jail in Massachusetts since their arrest in May. A Federal judge was attempting to block the extradition request from Japan, but on Wednesday, the State Department overruled her, the Taylors' lawyers said. Ghosn, for his part, maintains his innocence and says that he fled Japan because he didn't expect a fair trial in Japan's court system, which has a 99.9 percent conviction rate. Nissan reveals updated 2015 370Z Nismo among the faithful

Well before quick Honda Si models of the '80s or the performance juggernaut that the Toyota Supra and Mazda RX-7 became in the 90s, the Datsun 240Z was an early stake in the ground for Japanese sports cars. It was affordable, but the original Z-car was also a capable coupe that could show its tail to European and American rivals. Today, Nissan celebrates the car each year with fellow enthusiasts at its ZDAYZ event, and this year in North Carolina, it's surprising fans by launching the 2015 370Z Nismo there with some significant upgrades.
The biggest change is that the 370Z Nismo is available with a seven-speed automatic transmission for the first time. The six-speed manual is still standard, of course. But for those who don't want to use a clutch, Nissan is offering the new automatic with Downshift Rev Matching and a manual mode via paddle shifters. Power is still provided by the same 3.7-liter V6 as last year, producing 350 horsepower and 276 pound-feet of torque with a limited-slip differential at the back for added traction.
This hottest 370Z model also receives a brand-new GT-R-inspired bodykit that features a deeper front fascia, LED running lights and blacked-out headlight bezels. It also sports a new chin spoiler bearing the Nismo emblem and red accents that flow from the front, down the side sills and all the way to the rear bumper. At the back, there is also a smaller ducktail spoiler for a more mature look. The 2015 also wears cool 19-inch forged aluminum wheels by Rays with a new twin-spoke design and charcoal finish. Compared to last year's model, it's a much more mature-looking coupe.
