Ghosn flight prompts renewed focus on Japan's strict justice system

TOKYO — Carlos Ghosn's daring flight from Japan, where he was awaiting trial on charges of financial wrongdoing, has revived global criticism of the nation's "hostage justice," but in Japan is prompting talk of reversing more lenient curbs on defendants. The ousted boss of Japan's Nissan and France's Renault fled to Lebanon, saying on Tuesday that he had "escaped injustice" and would "no longer be held hostage by a rigged Japanese justice system." Ghosn was first arrested in November 2018 when his private jet landed in Tokyo and kept in jail for more than 100 days as prosecutors added more charges, all of which he has denied. He was released on $9 million bail in March — only to be arrested and bailed again the following month. He was facing four charges, including underreporting his Nissan salary and transferring personal financial losses to his employer's books while he ran Japan's No. 2 automaker. His apparent escape from Japan's legal system — Tokyo and Lebanon don't have an extradition treaty — will likely halt or even reverse a trend of recent years toward granting bail in more cases, said Colin Jones, a law professor at Doshisha Law School in Kyoto. “I would expect it to be more difficult for foreign defendants to get bail,” Jones said. In Japan, suspects who deny the charges against them are often detained for long periods and subject to intense questioning without a lawyer present, a system critics call "hostage justice." Japanese civil rights groups and the main bar lawyers association have long criticized a system that convicts 99.9% of criminal defendants. They say it gives too much power to prosecutors, who can detain suspects for long periods before indictment, and relies too much on confessions, some later found to have been forced and false. Ghosn's escape is clearly a shock to Japan's legal establishment. "This case raises the extremely serious issue of whether it's all right to continue the trend toward bail leniency," said former prosecutor Yasuyuki Takai. "The legal profession and lawmakers need to quickly consider new legal measures or a system to prevent such escapes," Takai, who was formerly with the special investigation unit of the prosecutor's office, told public broadcaster NHK.

Nissan recalls Rogue, Pathfinder, Infiniti QX60 for seat issue

Nissan and Infiniti are recalling their 2023 Rogue, Pathfinder and QX60 SUVs and CUVs to address a potential defect in their seat frame welds that can allow the frames to fail in the event of a collision. The number of vehicles that potentially shipped with weak welds is rather small — just over 12,000 — but the issue could nonetheless lead to injury if a failure occurs during a collision.  "The driverÂ’s powered seat may not be fully secured to the seat frame on certain Nissan Rogue, Pathfinder, and INFINTI QX60 vehicles," Nissan's report to NHTSA said. "As a result of this issue, the seat frame welds may detach from the rear inboard seat bracket. If this condition occurs, it may increase the risk of injury to the occupant in the event of a crash. In addition, the seat frame assembly may not meet certain FMVSS 207 and FMVSS 210 requirements because of this condition," Nissan said.  Nissan says there's no easy way for customers to detect the issue ahead of time, and that its seats need to be inspected by a service tech to see whether it is properly secured. Dealers will be instructed to check the driverÂ’s seat rail clearance to the inboard seat bracket, and if necessary, the dealer will remove and replace the affected driverÂ’s seat cushion frame, NIssan said. Nissan Cube dead for 2015

Another class cut-up has graduated from our motor pool. The Nissan Cube's indefatigable weirdness was likely both its chief selling point and its Achilles Heel, but Autoblog sources say that after a six-year run in the US, the niche player has been scrubbed from the Japanese automaker's lineup.
The move is hardly unexpected - there was confirmation from Nissan Canada that it was pulling the plug on the asymmetric little front-driver in its market back in May, and sales have not exactly been sparkling here in the States, either. In June, Nissan shifted just 336 Cubes, down 23.8 percent year over year. So far this year, Nissan has sold 2,294 units, a sales pace off 30.9 percent versus 2013. At its peak in 2010, the Cube remained firmly a niche vehicle, selling 22,968 units.
Nissan North America's Dan Passe, senior manager of product communications, maintains that "We are continuing to sell the 2014 Cube and we haven't made an announcement about future model plans," but Autoblog sources indicate that an official announcement will be coming in the next couple of months, and the Cube has been conspicuously left off of an exhaustive 2015 lineup "Charting the Changes" announcement released on Tuesday.
