Ex-Nissan chairman Carlos Ghosn indicted, may remain in jail for months

TOKYO — Nissan's ex-chairman Carlos Ghosn was charged Friday with breach of trust, according to the Tokyo District Court, making the star executive's release unlikely for months. Ghosn, arrested Nov. 19, was earlier charged with falsifying financial reports in underreporting his income by about 5 billion yen ($44 million) over five years through 2015. Ghosn; Greg Kelly, another Nissan executive; and Nissan as a legal entity also were charged Friday with additional underreporting of income, from 2015 through mid-2018. Ghosn's lawyer Motonari Ohtsuru said he would request that Ghosn be granted release on bail. His detention period for the breach of trust allegations was due to expire Friday. Kelly and Nissan were not charged with breach of trust. Those allegations center on Ghosn's handling of investment losses and payments made to a Saudi businessman. Ghosn, 64, says he's innocent. Suspects in Japan are routinely held for months until trials start, and Tokyo prosecutors maintain that Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, is a flight risk. Earlier this week Ghosn told a Tokyo court he was innocent, in his first public appearance since his arrest, and appealed for his detention to end. But the court rejected that request. "I have a genuine love and appreciation for Nissan," Ghosn told the court. "In all of my efforts on behalf of the company, I have acted honorably, legally and with the knowledge and approval of the appropriate executives inside the company." He said the compensation was never decided on, the investment deal never resulted in any losses to Nissan, and the payments to the Saudi businessman were for legitimate services related to dealers and investments in the Gulf. Ghosn, who appeared much thinner than before his arrest, came down with a fever the day after his court appearance, but has since recovered, Ohtsuru, the lawyer, said. His wife Carole Ghosn issued a statement overnight out of Paris, expressing concern over his sickness. "I am pleading with the Japanese authorities to provide us with any information at all about my husband's health. We are fearful and very worried his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment," she said. Apart from prosecutors, only embassy officials and Ghosn's lawyers are allowed to visit him. Such visits were canceled Thursday but resumed Friday.

Mitsubishi could use Lancer Sportback name on its version of the Nissan Leaf

Various reports might help with filling in some of the blanks in Mitsubishi's Momentum 2030 plan. That's the automaker's new initiative we heard about last month that Mitsubishi North America President and CEO Mark Chaffin said is "setting the stage for new powertrains and vehicles being introduced, new dealerships being opened, and new technologies being developed to make the shopping and ownership experience faster, easier and more enjoyable." The first hints of new product suggested a rugged plug-in hybrid van, something else in the Subaru Outback segment, and perhaps an electric pickup. And after Renault-Nissan-Mitsubishi alliance partner Nissan introduces a new-generation Leaf EV for the 2026 model year, Mitsubishi's supposed to get the Leaf for its own use. Based on a recent trademark renewal, Australian outlet Which Car? via Car and Driver suspects this EV (highlighted in the image above) could be called Lancer Sportback.  Car and Driver caught the fact that Mitsubishi renewed a trademark application for the name Lancer Sportback at the U.S. Patent and Trademark Office on March 12 of this year. And speaking of Lancers, the Japanese automaker applied to trademark Lancer Evolution on August 8 last year. The USPTO refused the registration, Mitsubishi filed an appeal that's still under consideration.    Which Car? doesn't say why it believes Mitsu might apply the Lancer (requested in 2020) or Lancer Sportback name to its little EV, but notes that the automaker's been reusing names around the world of late, such as Airtrek, Colt, Eclipse, and Eclipse Cross. There's more where that came from for us, C/D also tabbing Mitsubishi's trademark application for the name Montero, submitted last August and approved in February. That 4x4 launched as the Pajero in 1981 and sold in the U.S. as the Montero (and the Dodge Raider). The carmaker hasn't sold a Montero here since 2006, and ended Pajero production in 2021. A new model called the Pajero Sport filled the gap in the lineup, but that SUV is based on Mitsubishi's Triton pickup sold in overseas markets.  We've got a while to wait to figure out what's up. The new Leaf is expected to be a mini Nissan Ariya based on Nissan's Chill-Out concept from last year's Tokyo Mobility Show. Lebanon imposes travel ban on ex-Nissan boss Carlos Ghosn

BEIRUT — A Lebanese prosecutor imposed a travel ban on former Nissan boss Carlos Ghosn on Thursday, judicial sources said, after he was questioned over an Interpol warrant issued by Japan seeking his arrest on financial misconduct charges. Ghosn fled Japan to Lebanon, his childhood home, last month as he was awaiting trial on charges of under-reporting earnings, breach of trust and misappropriation of company funds, all of which he denies. The Lebanese judicial authorities also asked Japan for its file on Ghosn, including the charges against him, and will not question him again until the information is received, one of the sources said. Carlos Abou Jaoude, a Beirut-based lawyer for Ghosn, told Lebanese broadcaster MTV Ghosn was "very comfortable" with the proceedings in Beirut. "He is very comfortable with the path," Jaoude said, adding that Ghosn was also comfortable himself "especially after what he went through". The decision issued by the prosecutor, Judge Ghassan Ouiedat, requires Ghosn to keep the authorities informed of his place of residence, the judicial sources said. Ghosn would surrender his French passport to the Lebanese authorities later on Thursday, one of the sources said after the questioning, which took place at Beirut's Justice Palace, the headquarters of the judiciary. The Brazilian-born Ghosn said on Wednesday he had escaped to Lebanon to clear his name and was ready to stand trial anywhere he could get a fair hearing. Ghosn said he was ready to stay for a long time in Lebanon, which does not allow the extradition of its nationals, and a source close to the 65-year-old has said his legal team is pushing for him to be tried in the country. In addition to the Interpol warrant, Ghosn was also questioned over a formal legal complaint filed against him by a group of Lebanese lawyers who accuse him of "normalization" with Israel over a visit he made there in 2008. The prosecutor released him with the same condition, that he keep the authorities aware of his place of residence, the sources said. There was no immediate statement from the prosecutor's office. In his comments to MTV, Ghosn's lawyer Jaoude said a statement would be issued by Ghosn's team later. Ghosn said on Wednesday he had made the trip as a French citizen and an executive of Renault to sign a contract with a state-backed Israeli firm to sell electric vehicles, and had been obliged to go because the board had requested it.
