Carlos Ghosn re-arrested and thrown back in jail [UPDATE]

TOKYO — Tokyo prosecutors arrested Nissan's former chairman Carlos Ghosn on Thursday for a fourth time, on fresh allegations that cut short his brief time outside detention. Early in the morning, Ghosn was taken from his apartment in Tokyo to the prosecutors' office and then sent to the Tokyo Detention Center, the same facility where he spent more than three months following his arrest in November. He had been released on bail just a month earlier. It's unclear how long Ghosn may be detained under the latest arrest, which involves what prosecutors said was a new alleged crime. "My arrest this morning is outrageous and arbitrary," Ghosn said in a statement issued Thursday. "It is part of another attempt by some individuals at Nissan to silence me by misleading the prosecutors. Why arrest me except to try to break me? I will not be broken. I am innocent of the groundless charges and accusations against me." The prosecutors defended the move, saying the latest allegations are a new case requiring precautions to prevent Ghosn from destroying evidence. They allege $5 million in funds sent by a Nissan subsidiary to an overseas dealership were diverted to a company controlled by Ghosn. "We now have a totally different case, and we are only doing what we think is right," Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutor's Office, told reporters. "As a result of our investigation, we have a new case in which he must be detained, and we have appropriately obtained an arrest warrant from the court," he said. Ghosn, 65, was first arrested on Nov. 19 on charges of under-reporting his compensation. He was rearrested twice in December, including on breach of trust charges. The multiple arrests prolong detentions without trial and are an oft-criticized prosecution tactic in Japan's criminal justice system. The allegations in the most recent arrest cover three money transfers from 2015 through last year, according to the prosecutors. Kukimoto said the new allegation of breach of trust is different from an earlier charge made in January. The companies where the money was transferred to, the motives, and the alleged scheme are all different, he said. He refused to identify the three companies allegedly involved but said one company was in effect owned by Ghosn. Unlike an earlier case, in which Ghosn caused damage to Nissan to benefit himself and a business partner, this time it was merely "for his own personal benefit," Kukimoto said.

Nissan is pretty darn serious about being king of the EV industry. Just see what Chief Planning Officer Andy Palmer has to say at the launch of the e-NV200: "When it comes to zero emissions, we're absolutely religious. We'll be the absolute, No. 1 leader in zero emissions. No doubt. That's our positioning." Bold words, to be sure. Toyota, on the other hand, ended its collaboration with Tesla (whom Nissan mustn't forget about in its quest to reign supreme in the EV world) to build the RAV4 EV, and will focus instead on hybrids and testing the waters with hydrogen cars. To celebrate 25 years of TDI technology, Audi is releasing the A7 Sportback 3.0 TDI Competition special edition in Europe. The Competition uses Audi's biturbocharged, 3.0-liter diesel engine boosted to 326 horsepower, giving the car a 0-62 time of 5.1 seconds. It comes with the S line sport package and is offered in four exterior colors: Daytona Gray, Misano Red, Nardo Gray and Sepang Blue. The interior is black leather, with the option of Misano Red or Agate Gray contrast stitching. The Competition edition will go on sale in August starting at ˆ72,000 (about $97,700). There was another Tesla Model S crash recently, this one at the Tesla Store. The driver apparently crashed the freshly purchased car into the Tesla sign before even making it off the lot. According to Reddit user s1lentway, who was at the Tesla Store in Fremont, California when it happened, "We believe this is someone who just got their car. They must have been driving it for less than a minute and lost control, crashing right into the sign missing the showroom glass windows only by a few inches." Nissan Xterra discontinued after 2015

Another great big subtraction in the choice of proper off-roaders comes with news from Edmunds that the Nissan Xterra will meet its maker after the 2015 model year. Sales of the body-on-frame SUV introduced in 1999 declined seven percent last year compared to 2013, a total of just 16,505 getting off dealer lots. That's about 1,800 more sales than the Toyota FJ Cruiser achieved for the year, another rugged trail runner recently dispatched into the ether. Meanwhile, the king-of-the-hill Jeep Wrangler almost matched those annual sales number each month in 2014; it moved 19,235 in May alone. Nissan hasn't exactly cared about the Xterra for years; Edmunds reported in 2013 that Nissan was "mulling the Xterra's future" and would take a year to decide if it was going to keep going. But it has been clear for years that the company wasn't too interested in its hardcore off-roader in spite of its "enthusiastic fan base inside and outside the company." The last visible refresh came in 2009, when it was 4Wheeler magazine's SUV of the Year, the next minor feature updates not arriving until 2014. And the Nissan-backed off-road triathlon series the Xterra was named for died in 2006. That's why there's no business case for throwing money at re-engineering the Xterra's safety and emissions specs, especially in a world gone crazy for subcompact crossovers. We contacted Nissan for comment on the report and asked if another Nissan vehicle, like the Rogue, would be positioned as a near-replacement, as has been speculated before. Product communications director Dan Bedore told us, "Nissan has made no announcement as to the future status of Xterra. For proprietary reasons, we do not discuss future product plans or comment on media speculation about future plans." Right now we can hear the Jeep Wrangler at the top of the mountain screaming, "Nobody wants a piece of this? Really?!" So come on, General Motors - it's up to you now.
