What to expect from the Japanese trial of Nissan and Greg Kelly

TOKYO — The criminal trial against Japanese automaker Nissan and its former executive Greg Kelly will open in Tokyo District Court on Tuesday. ItÂ’s the latest chapter in the unfolding scandal of Carlos Ghosn, a superstar at Nissan until he and Kelly were arrested in late 2018. Five questions and answers about the trial: Q: WHAT ARE THE ALLEGATIONS? A: The charges center around KellyÂ’s role in alleged under-reporting of GhosnÂ’s future compensation by about 9 billion yen ($85 million), a violation of financial laws. Kelly says he is innocent. Nissan, which is also similarly charged, has already acknowledged guilt, made corrections to the compensation documents submitted to the authorities, and has started paying a 2.4 billion yen ($22.6 million) fine. Q: WHAT HAPPENS TO GHOSN? A: Probably nothing. He skipped bail late last year and is now in Lebanon, which has no extradition treaty with Japan. Two Americans, Michael Taylor and his son Peter Taylor are being held in Massachusetts without bail, suspected of having helped Ghosn escape by hiding in a box on a private jet. A U.S. judge recently approved their extradition to Japan. The case is now before the U.S. State Department. Q: HOW DO CRIMINAL TRIALS PROCEED IN JAPAN? A: The trial, before a panel of three judges, is expected to take about a year. There is no jury. Juries are selected only for extremely serious cases in Japan, such as murder. In principle, there are no plea bargains although backroom deals are made all the time. Closed pre-trial sessions are held ahead of the trialÂ’s opening, often for months before the real trial begins. Japan's legal system has come under fire from both within and outside the country as “hostage justice” because suspects often are held for months and interrogated without a lawyer present, often leading to false confessions, according to critics. Q: WHAT ARE KELLYÂ’S CHANCES? A: More than 99% of criminal trials in Japan result in a conviction. Japanese Justice Minister Masako Mori, in an online presentation in English hosted by the Japanese Embassy in the U.S., argued the conviction rate is so high because Japan prosecutes only about a third of the cases that come up, choosing only those that “result in guilty verdicts.” She insisted there is a “presumption of innocence.” She declined comment on KellyÂ’s case.

These are the 'Greenest' and 'Meanest' cars in 2015

As has become tradition, the American Council for an Energy-Efficient Economy (ACEEE) has come up with a ranking of what it refers to as the "greenest" cars of 2015, and, by way of contrast, a list of the so-called "meanest" cars, so those who value eco-friendliness over all else can choose which vehicles they should or should not consider buying. As you may expect, electric cars make up the majority of the greenest cars on the list, but, perhaps surprisingly to many, the Tesla Model S didn't make the cut. It's worth noting, too, that where the electricity an owner uses to charge their electric vehicle has a big impact on its overall environmental impact. "A car that is charged using electricity generated from natural gas or renewables is going to have significantly less impact on the environment than one charged on a coal-heavy grid," says ACEEE lead vehicle analyst Shruti Vaidyanathan. The ACEEE's list for 2015 looks very different than it did in 2014. It's an interesting collection, though – and we're sure this goes without saying, really – we'd recommend doing a bit more research into each vehicle and how it might fit into your daily life before making any purchase decisions. Only 3 new cars cost under $20,000. Here’s what you should buy used instead

Looks like some more people have realized something we pointed out late last year. There are only three new cars under the magic $20,000 price limit currently for sale in the United States. Those three vehicles are the Nissan Versa with a starting price of $16,925 (all prices here include destination fee), the Kia Rio at $17,390 and the Mitsubishi Mirage at $17,650. Should push come to shove, so to speak, we'd probably pick the Nissan as our top choice among those three due to its practicality, comfort and overall polish when compared to its similarly priced peers. But really, as we've suggested before, there are better options. Our top pick for a used vehicle under $20,000 remains the Chevy Volt. It's stylish, comfortable, practical and, above all else, efficient, assuming you can plug it in at home. If you don't have access to a plug at home, you'll likely be able to find a very gently used car for the same price as one of the budget options above. We'd check out the Honda Fit, Kia Soul, Subaru Impreza, Toyota Corolla hatchback and Volkswagen Jetta from the  model years and aim for something with under 20,000 miles and with a year or two left of its factory warranty. A quick inventory search shows that some of those cars, notably the Impreza and Jetta, can even be found Certified Pre Owned in most parts of the country. For what it's worth, with the average new car transaction price hovering alarmingly close to $50,000, we wouldn't expect to see any more options coming any time soon for well under half that sum.
