Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

Nissan prices replacement Leaf battery at $5,500

The battery pack is the single most expensive component in a plug-in vehicle and, until now, figuring out the cost to replace one has been a bit of a mystery. Last year, Nissan tried a $100/month price for a new battery in its popular Leaf, but was loudly criticized for that attempt. Today, Nissan is changing gears with a big announcement regarding the price of a new pack for your Nissan Leaf: $5,500 to buy. With an asterisk. Nissan's Brian Brockman, writing at My Nissan Leaf, announced that Nissan Leaf replacement batteries are now available to purchase at certified Leaf dealers in the US at a suggested retail price of $5,499. These packs are the ones found in 2015 Leaf models, which are similar to the ones the Leaf has always had, just with a different, better battery chemistry. To buy a new pack, you need to give Nissan your original battery pack (which Nissan says will be recycled and has a value of $1,000) and the $5,500 "does not include tax, installation fees or an installation kit required for 2011 and 2012 vehicles." That kit costs around $225. A $100/month financing program will still be available (details will be made available later) but now it will have an end date and the driver will own the pack at the end of the payment process. Ever since the Leaf entered the market in late 2010, Nissan has been dealing with degrading battery issue, both as a real thing (in warm climates like Arizona) and as a worry in the mind of potential customers. Now that we know how much it'll cost to get a new pack, we can calculate that the overall cost for a new 24-kWh pack is now officially $6,500. That means the price to a customer is less than $270-per-kWh. That's quite low compared to some early estimates, right on target with others and a very big deal for EV shoppers and drivers out there. Panoz mulls suing Nissan for ZEOD RC's Deltawing likeness

Imitation might be the sincerest form of flattery, but in racing, where something as simple as a car's shape can lead to a competitive advantage, imitation can be a big no-no. That reality is being played out right now, with the DeltaWing prototype and the Nissan ZEOD RC. The two cars, as you can see from the images above, bear a striking resemblance to each other. They're so similar, in fact, that Dr. Don Panoz, one of the big names behind the DeltaWing program, is assigning some legal eagles to investigate any patent infringement.
The similarity shouldn't be a shock, though. Both cars are penned by Ben Bowlby, and the DeltaWing - which will be arriving as a coupe in the very near future - had Nissan branding and power for a not-insignificant amount of time. But for Panoz, the ZEOD RC's resemblance is just a bit too much, as he told Autoweek, "It's been interesting to watch people from Nissan trying to dodge the question, but the fact is that in their own press release they admit that the configuration of the ZEOD is the same as the DeltaWing. And we do have patents, in fact another one was just issued last week. We are in discussions with our legal advisors and we'll see what happens."
Frankly, it's not difficult to see what Panoz means. The general shape of the ZEOD RC, with its wide rear track and narrow front track arrangement - not to mention the headlights mounted over the rear wheel arches and any arrangements not visible under the body - are so reminiscent of the DeltaWing that differences like the shape of its closed cockpit and more upright front end might not prove different enough to avert Panoz's legal action.
