Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Nissan may take control of struggling Mitsubishi Motors

Update: The reports were largely correct. Nissan will take a 34 percent stake in Mitsubishi for roughly $2.2b. Read all about it here. Reports say Nissan will buy a controlling stake in Mitsubishi Motors, either 30 or 34 percent, for about 200 billion yen or $1.84 billion. Nissan and Mitsubishi motors are currently part of a joint venture, NMKV, to build minicars together. Nissan is also responsible for reporting fuel-economy discrepancies with cars built under the joint-venture agreement, which put Mitsubishi in its current weakened state. Earlier today, reports surfaced that the fuel-economy issues were wider ranging than originally thought. Mitsubishi now admits that all of its Japanese-market cars sold since 1991 could have had faked fuel-economy data. Shares of Mitsubishi Motors have dropped by about half since the scandal was uncovered, opening the door for a takeover. While Nissan is a much larger company, it can benefit from Mitsubishi's 60-percent share of Japan's minicar market. The two companies also had plans to build electric vehicles together in the joint venture. Panoz and DeltaWing suing Nissan over BladeGlider concept

Similarity is bound to occur in an industry where most of the products follow the same basic formula. But once in a while a new design comes along that doesn't quite reinvent the wheel, but comes pretty damn close. The DeltaWing project was one such design - and Nissan, the car's designers allege, stole that design.
After the DeltaWing proposal was rejected by the IndyCar series, its creators took it to Le Mans and brought Nissan on board to supply the power. Nissan subsequently pulled out of the program and came out with the ZEOD RC hybrid racer (right), bearing a suspiciously similar design with an unusually narrow front track at the end of a long nose cone, and a wider track at the back. The Japanese automaker then displayed the BladeGlider concept (below, right) at the Tokyo Motor Show, envisioning a translation of the same formula into road-going form.
The similarity did not escape Don Panoz, who - after making sports and racing cars under his own name and founding the now-defunct American Le Mans Series - was a central figure in bringing the original DeltaWing to life. Now Panoz has filed a lawsuit against Nissan, soliciting the courts to issue a cease-and-desist order on both the ZEOD RC and BladeGlider projects, naming Nissan motorsport chief Darren Cox and Ben Bowlby (who defected to Nissan from the DeltaWing program) as part of the suit.
