Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

2019-22 Mitsubishi Outlander Sport recalled for transmission fault

Mitsubishi says 76,508 Outlander Sports from the 2019 to 2022 model years need to return to dealers for updated software, according to a recall notice from the National Highway Traffic Safety Administration. Some code released for the electronic control unit managing the continuously variable transmission can suffer a fault if the unit loses power temporarily. In such instances, when power is restored, the software can command the CVT to reset to the lowest 'gear' possible. If this occurs at high speeds, the engine over-revs, and a piston can come into contact with an exhaust valve which then causes the engine to stall. It also kiboshes the engine. This is a bad possibility anywhere, but especially on the highway. It took Mitsubishi engineers about two years to figure out the problem, during which the company has dealt with 50 reports and warranty claims, but says it knows of no injuries or accidents due to the problem. The only Outlander Sports involved in the recall are those with a CVT that need a mechanical key to be started, built from July 31, 2018 to and May 11, 2022. Models with the manual gearbox or push-button start aren't affected. For now, the 2011 to 2018 Outlander Sport isn't included, the software change said to coincide with the 2019 model year. Dealers will install new software that decides on the proper CVT target ratio after a transmission control unit reset.    The automaker said it will begin notifying owners by mail on August 24. Watch Mitsubishi Express van bend its way to 0-star crash test rating

Mitsubishi became a champion of economies of scale when it joined the Renault-Nissan alliance in 2016, but the merger triggered at least one undesirable side effect. The Express, a badge-engineered version of the Renault Trafic van, received a zero-star crash test rating from the Australasian New Car Assessment Program (ANCAP). Released in Australia and in New Zealand in 2020, the Express was damned by the safety watchdog for lacking chest protection, a central airbag to prevent the occupants from hitting each other and an airbag for the passenger sitting in the middle of the three-person bench. ANCAP also noted the model is not available with electronic driving aids, like automatic emergency braking, pedestrian detection and lane-keeping assist. Mitsubishi Express crash test View 8 Photos Consequently, the Express scored 55% for adult occupant protection, 40% for vulnerable road user protection, and 7% for safety assist. ANCAP argued the Express is a safety hazard even to motorists not traveling in it. "The front structure of the Express presented a high risk to the occupants of an oncoming vehicle," it wrote, adding that this gave the van a penalty. It pointed out that more driving aids would have increased the rating, however. While vans often lag behind in the safety department, scoring zero stars is highly unusual, especially in 2021; the last-generation Express managed to score a one-star rating in 2011. The Toyota HiAce tested in 2019 received a five-star rating, while the made-in-China LDV G10 managed to score three stars in a 2015 crash test.
