Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Mitsubishi planning high-performance Outlander PHEV under revived Ralliart banner

Mitsubishi is finally getting some of its mojo back with its redesigned — and competitive — Outlander. The company reportedly plans to build on that momentum with a high-performance variant of the SUV, bolstering its newly revived Ralliart performance division in the process.  Wait, a non-luxury performance SUV? Well, if any company can pull it off it would be Mitsubishi. It has the history of its WRC victories and Paris-Dakar Rally dominance to build on. Nearly its entire racing heritage has been forged on dirt, not tarmac, so a hotted-up Mitsu SUV doesn't seem so farfetched.  According to Japan's Best Car magazine, the all-out Outlander will be based on the Outlander Vision Ralliart concept shown over a year ago at the 2022 Tokyo Auto Salon. The model will supposedly be called the Outlander PHEV Ralliart, and will feature extensive tuning to set it apart from the standard version. Best Car reports that the chassis will be reinforced to increase body rigidity. Mitsubishi will also strengthen the suspension and visually distinguish it with unique aero bits. What that may be isn't specified, but the Auto Salon concept had wider fenders in front and rear, a new front grille and bumper, and big diffuser beneath a redesigned rear fascia. The concept also came with larger rotors and six-piston calipers in front. The Outlander PHEV Ralliart's drivetrain, says Best Car, will based on the 2.4-liter plug-in hybrid setup on the base car. However, combined power between gasoline and hybrid systems will total an estimated 286 horsepower. Finally, the magazine predicts that the Outlander PHEV Ralliart will arrive in 2024. Japanese pricing is approximated at JPY5.5 to 6.1 million, which converts to $40,300 to $44,700 at current exchange rates, but we expect it to be closer to the high end of that range. With crossovers and SUVs as the de facto car these days, it was only a matter of time before mainstream marques began souping up such daily drivers. If Honda can create an 800-horsepower CR-V race car, a sports Outlander seems only natural. We'll just be here waiting for the first crossover racing league. Carlos Ghosn's son predicts surprises at ex-Nissan chief's day in court

PARIS — The son of former Nissan chairman Carlos Ghosn said in an interview published Sunday that people will be surprised when his father, detained since Nov. 19 for allegedly falsifying financial reports, recounts his version of events to a Tokyo court on Tuesday. Anthony Ghosn, 24, told France's Journal du Dimanche that his father — who will remain detained until at least Jan. 11 — will get 10 minutes to talk at the hearing, being held at his own request. "For the first time, he can talk about his version of the allegations against him," Anthony Ghosn said in the interview with the weekly paper Journal du Dimanche. "I think everyone will be rather surprised hearing his version of the story. Until now, we've only heard the accusers." The son has no direct contact with his father, and gets information via lawyers. He said his father, who for decades was a revered figure in the global auto industry, has lost about 10 kilograms (22 pounds) eating three bowls of rice daily, but he reads books and "he resists." Ghosn refuses to cave in, said his son, contending that he would be freed from detention if he admitted guilt to the prosecutor. "But for seven weeks, his decision has been quite clear ... He won't give in," Anthony Ghosn said, adding that he would be wearing prison clothes and handcuffs in court. Countering media portrayals, he insisted his father, a Brazilian-born Frenchman of Lebanese ancestry, is "not obsessed by money." "He always told us that money is but a means to help those you love, but not an end unto itself." Ghosn is charged with underreporting his pay by about 5 billion yen ($44 million) in 2011-2015, and faces a breach of trust allegation. He led Nissan Motor Co. for two decades and helped save the Japanese automaker from near bankruptcy. He remains head of France's Renault car company, which owns 43 percent of Nissan. Another Nissan executive, Greg Kelly, was arrested on suspicion of collaborating with Ghosn on the underreporting of income and was freed Dec. 25 on 70 million yen ($635,600) bail after more than a month in detention.Related Video:
