Ghosn out at Nissan, still in at Renault, still in jail in Tokyo and facing more charges

When the corporate jet carrying Renault- Nissan- Mitsubishi CEO Carlos Ghosn landed at Tokyo Haneda airport on November 19, Japanese authorities had already taken position on the tarmac, waiting for him. Police and authorities representing Tokyo prosecutor's office boarded the plane to query Ghosn about financial improprieties, and ended up taking Nissan's chairman and CEO into custody. A few days later, on November 22, Nissan's board voted to remove Ghosn from both positions for what it classified as "significant acts of misconduct." The charges include understating his income in filings to the Tokyo Stock Exchange by at least $44 million, and misusing company funds. Japanese police arrested Greg Kelly as well, the high-ranking Nissan exec said to have assisted Ghosn in the subterfuge. Ghosn and Kelly remain on Nissan's board until a shareholder vote is held to decide those positions. Kelly was Nissan's first American director, and the carmaker's former head of human resources. In France, Renault's board voted to keep Ghosn in his positions, and has requested details from Nissan about the alleged improprieties. The board put Thierry Bollore in the role of deputy CEO with all of Ghosn's powers while Ghosn is "incapacitated," and lead independent director Philippe Lagayette will act as temporary chairman. Nissan has since told Renault that it is investigating financial malfeasance at RNBV, the Amsterdam-based joint-venture company that oversees the alliance. Mitsubishi has watched from afar, only saying it will perform its own investigation, and could remove Ghosn. Tokyo police can hold a suspect for 72 hours for initial questioning without charges. With the deadline looming, Tokyo prosecutors asked the court for, and were granted, a ten-day extension. If they choose, prosecutors can request another ten-day extension. Within 23 days, however, prosecutors either need to charge Ghosn and Kelly, or release them. There are several charges that acquire more details by the day. The most serious accusation is that Ghosn understated his pay from 2011 to 2015 by half, claiming roughly $44 million in remuneration when he actually received around $88 million. Over the weekend, it came out that Japanese prosecutors could be working on new charges of Ghosn under-reporting his salary since 2015 by $27 million. A Japanese newspaper said Ghosn told Kelly in an email to lie on the financial statements.

Europe on track to buy more PHEVs than hybrids by 2019

LMC Automotive, formerly the forecasting division of J.D. Power & Associates, predicts that plug-in hybrids will sell better than conventional hybrids by 2019. By 2021, it envisions PHEV sales at 600,000 units yearly compared to 325,000 standard hybrid sales, and by 2024 PHEV sales are expected to account for 1.2 million sales every year. Part of LMC's prediction is based on a few factors, such as that it believes "electric-only operation will come to be seen as a true luxury characteristic and will be prized sufficiently to command significant premiums." Certain PHEVs are helped in countries like the UK and The Netherlands by generous incentives or other perks, like avoiding inner London's congestion charge, that allow them to address their price differences compared to standard offerings. And the number of PHEVs on the market will soon eclipse regular hybrids, coming from makers across the spectrum. Volvo has twice recently, and only belatedly, learned of the popularity of PHEVs: in 2013 it had to triple production of the V60 PHEV, and just this month it said demand for its XC90 PHEV is four times expectations. The Porsche Panamera E-Hybrid is outselling the traditional hybrid Panamera by more than seven-to-one. And then there's Mitsubishi Outlander PHEV, Europe's best-selling PHEV with 19,855 units, a volume more than three times larger than the second-best seller. Although LMC sees hybrid growth slowing, they're still doing well. Toyota and Lexus build the top-five selling traditional hybrids in Europe, combining for 72 percent of European sales, with the new Auris and Yaris hybrids alone selling 123,506 units in 2014. For LMC's forecast to come true, Europe will need a spectacular change in buying habits, since the top ten conventional hybrids tallied 175,847 sales in 2014, and the top ten PHEVs rang up 36,138 sales. Employee warned Mitsubishi execs about mileage cheating in 2005

A damning report from the committee brought in to investigate Mitsubishi's alleged fuel economy fixing scandal has revealed a new employee stepped forward and implored the company to play it straight on its mileage data... Eleven years ago. The employee, identified in the report as F, pushed for honesty during a company workshop in February 2005, The Asahi Shimbun reports. The then-new worker told 20 company officials, including senior members of the performance testing department, that the way Mitsubishi measured fuel economy was different from the way government's method. Instead of acting on F's protests, officials said they had no memory of them, the report claims. The four-person committee, made up of lawyers and industry experts, isn't buying the excuse. "It is difficult to accept their explanations that they have no recollections because a new employee pointing out such a problem must have had a (strong) impact," the report read. But F's comments weren't the only internal sign that Mitsubishi allegedly ignored. In a 2011 questionnaire, multiple employees submitted responses claiming that the company had been falsifying data. But according to the committee's report, Mitsubishi's development department issued a report denying there was even a problem, which the company's execs accepted without question. According to The Asahi Shimbun, Mitsubishi CEO Osamu Masuko revealed that an internal investigation – which also denied F's remarks – acknowledged that the company hadn't followed government rules regarding fuel economy measurements since 1991. "We lacked unity needed to detect problems within the company and to solve them," Masuko-san said, backing up the committee report's claim that the company was divided. "From now on, we need to decide how to change our way of thinking."
