Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

1,500 Mitsubishi Lancer Evo, Ralliart models recalled for fuel tank wear

The Mitsubishi Lancer Evolution is famous for its ability to slide at high speed through the dirt in rally stages all over the world, but 1,497 examples of the 2014 and 2015 Evo and Lancer Ralliart are now facing a recall in the US for potential wear to their fuel tanks. According to the National Highway Traffic Safety Administration, the right parking brake cable can rub against the tank, and this can cause a protective coating to come off, leading to rusting or even a possible leak. NHTSA documents (as a PDF) report no actual claims of this happening, though. To rectify the problem, Mitsubishi dealers will replace the right parking brake cable on all of the affected models. While doing the work, they'll also inspect the fuel tank, and if worn, it'll be switched out, as well. Notifications to customers will go out in the next couple of weeks, according to Mitsubishi spokesperson Alex Fedorak to Autoblog. REMEDY: Mitsubishi will notify owners, and dealers will replace the right parking brake cable, and inspect the fuel tank, free of charge. If the fuel tank's exterior coating shows signs of damage from abrasive contact with the right parking brake cable, the fuel tank will also be replaced, free of charge. Daimler declares success in electric truck trial [w/video]

Last year, Daimler launched a project to see how eight Fuso Canter E-Cells performed in daily urban service in Portugal. After over 32,000 miles on the road, the newly released results showed astounding figures. Compared to their diesel-counterparts, the commercial EVs slashed operating costs by 64 percent. The trucks were also great for the environment with a 37-percent drop in CO2 emissions after taking into account how the country makes power. Daimler gave the trucks to Portuguese cities and businesses, and the users definitely didn't baby them. In Lisbon, the EV disposed of vegetation, and the Canter E-Cell collected recyclables in Porto. The one with the parcel service Transporta covered over 8,700 miles to make deliveries during the year. On average, the testers used the vehicles about 31 miles a day, but 68 miles was the record distance during the trial. "The results of the practical tests have shown that we are on the right track," Marc Llistosella, President and CEO of Mitsubishi Fuso Truck and Bus Corporation said in Daimler's announcement. The Daimler Trucks Centre of Competence for Hybrid Technology developed the small run of Canter E-Cells. The models ditch the usual 3.0-liter diesel in favor of an electric motor that produces 148 horsepower and 479 pound-feet of torque.
