Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Japan calls Ghosn's escape inexcusable and vows tighter immigration checks

TOKYO — Japan's justice minister on Sunday called the flight of former Nissan Chairman Carlos Ghosn as he awaited trial on financial misconduct charges inexcusable and vowed to beef up immigration checks. Justice Minister Masako Mori said she had ordered an investigation after Ghosn issued a statement a few days ago saying he was in Lebanon. She said there were no records of Ghosn's departure from Tokyo. She said his bail has been revoked, and Interpol had issued a wanted notice. Departure checks needed to be strengthened to prevent a recurrence, Mori said. While expressing deep regret over what had happened, Mori stopped short of outlining any specific action Japan might take to get Ghosn back. Japan does not have an extradition treaty with Lebanon. “Our nationÂ’s criminal justice system protects the basic human rights of an individual and properly carries out appropriate procedures to disclose the truth of various cases, and the flight of a suspect while out on bail is never justified,” she said in a statement. MoriÂ’s statement was the first public comment by a Japanese government official after the stunning escape of Ghosn, once a superstar of the auto industry. Tokyo prosecutors issued a similar statement Sunday. They had opposed Ghosn's release on bail, arguing he was a flight risk. First arrested in November 2018, Ghosn was out on bail over the last several months, and more recently had moved into a home in an upscale part of Tokyo. He has repeatedly said he was innocent. His statement from Beirut said he was escaping injustice. Japan's justice system has come under fire from human rights advocates for its long detentions, the reliance on confessions and prolonged trials. The conviction rate is higher than 99%. Even if Ghosn had been found innocent, the prosecutors could have appealed, and the appeals process could have lasted years. Ghosn's trial was not expected to start until April at the earliest. During that time, he had been prohibited from seeing his wife, and was only allowed a couple of video calls in the presence of a lawyer. Ghosn had been charged with underreporting his future compensation and breach of trust in diverting Nissan money for his personal gain. Although the details of his escape are not yet clear, Turkish airline company MNG Jet has said two of its planes were used illegally, first flying him from Osaka, Japan, to Istanbul, and then on to Beirut, where he arrived Monday and has not been seen since.

Junkyard Gem: 1977 Dodge Colt Mileage Maker Coupe

While Ford and GM each had the resources to develop their own Michigan-designed subcompacts for the dawn of the 1970s— the Pinto and Vega, respectively— Chrysler couldn't afford the huge price tag for such a project. Instead, Chrysler's European operations were tapped for a couple of models that sold well enough on the other side of the Atlantic, giving us the Plymouth Cricket (known as the Hillman Avenger in the UK) and the Simca 1204 (aka the Simca 1100 in France). American car shoppers gave those two models the cold shoulder, but then Chrysler found genuine sales success by making a deal with Mitsubishi to sell the Colt Galant with left-hand drive. This became the Dodge Colt, with sales beginning in the 1971 model year. Though the 1971-1978 rear-wheel-drive Colts were once as commonplace as Corollas or B210s on American roads, they have all but disappeared today. That makes today's Junkyard Find, discovered in a Denver-area yard last week, particularly interesting. This car shows signs of having been in the hands of a speed-crazed enthusiast owner, including an aftermarket steering wheel and one-piece racing seats with slots for five-point harnesses. The primer-gray paint is another clue. The rear-wheel-drive Colts were reasonably quick for their time, and they could be made genuinely quick with basic engine upgrades. This Mitsubishi Saturn four-banger has a tube header, hot-rod ignition system, and a two-barrel (Mikuni-made) Solex carburetor. We can assume there's probably some kind of cam upgrade under the valve cover, too. The shifter is gone, but the original transmission in this car was either the base four-speed or optional five-speed manual. A three-speed automatic was available for $270 (about $1,275 today). Later on, front-wheel-drive Colts (and Mitsubishi Mirages) could be bought with the Twin-Stick overdrive rig, which gave drivers eight forward speeds and the opportunity to make Twin-Stick beer taps. The 1977-1978 Dodge Colt two- and four-door sedans were based on the Mitsubishi Lancer and were a bit smaller than the 1971-1977 cars, while the wagon version moved to the Galant Sigma platform. The build tag shows that this car started life as the cheapest 1977 Colt model, the "Mileage Maker" two-door sedan (Dodge dealers called it a coupe, so that's what I'm calling it in the title).
